<br />7. Miscellaneous Items <br />A. Monthly Activity Report <br />Chief Heckman noted that Officer Corlew had finished field training and was <br />patrolling on his own and Officer Arnson should finish field training by mid January if <br />not sooner. <br /> <br />B. Monthly Department Summaries <br />No comment or discussion. <br /> <br />C. Letter of Response from Automedics <br />The Chief referenced the letter contained in the Commission Packet and noted that <br />Automedics had agreed to the changes after discussions with the Chief. The Chief <br />is looking forward to our association with Automedics for towing services. <br /> <br />Commissioners engaged in a discussion about forfeitures of vehicles based on <br />information at the League of Minnesota Cities November Seminar in White Bear <br />Lake. The Chief explained that state law is poorly written. The Chief and other <br />Police Chiefs have tried to eliminate the liability issues to Departments at the state <br />legislature. In summation, although forfeiture can be costly to a city if overturned in <br />the courts, Cities are liable if a subsequent crime is committed by releasing an <br />impounded vuhicle. <br /> <br />D. Letter to Cities Reference Police Facility <br />The Chief expressed thanks for the background letter, documentation, and <br />resolution presented to the City Councils for adoption. The Chief remarked thaf the <br />Department as a whole was grateful. <br /> <br />Commissioners asked for clarification of the sample resolution and Commissioner <br />Swedberg stated that the resolution was intended to: <br />· State the issues as presented by employees <br />· Identify that there are immediate health and safety issues and longer term facility <br />needs. <br />· Alert Councils to the fact that expertise to examine the questions must be <br />obtained outside the Department <br />· Request authority to exceed the 2003 CLPD budget for this purpose not to <br />exceed a total cost of $30,000 prorated by the population of each City as <br />required by the Joint Powers Agreement for non-budgeted expenditures <br /> <br />Commissioner Swedberg stated that the cost of the consultant(s) is unknown and <br />fheref1""\re fhQ rOS1""\!J ,fi1""\.... nr1""\\VirloS f1""\r "....1""\f f1""\ Qvt"'oorl" as a ""1""\Sf ""an The a,...h ,.,,1 ""1""\C'"fC'" <br />\.II I IVI \.IIV'I ""' '-'I\.ALIVII 1'-'1 V IU"-,,, IVI IIV,- LV ......Av""'VY VV Lv J-.-'- I II v.......U::U vV":'l":' <br />may be far less than the maximum cap, but may not exceed the cap. <br /> <br />Commissioners expressed a wide range of views that included: <br />· The need to control costs that are averaging better than 1 0% for police services <br />· The lessor of the existing facilities needs to address health and safety issues <br />before contracting <br />· Who will the Commission turn to for legal advice on the lease? <br /> <br />7~ <br />
