July 13, 2016 City Council Meeting Minutes <br /> <br />Mayor Wilharber provided an opportunity for Council Members to modify the minutes. <br /> <br />Motion by Council Member Fehrenbacher, seconded by Council Member King to approve <br />the July 13, 2016 City Council Meeting Minutes as presented. All in favor. Motion carried. <br /> <br />VI. CONSENT AGENDA <br /> <br /> <br />1.City of Centerville July 14, 2016 through July 27, 2016 Claims (Check #30360- <br />30369) & (Check #30370-30393) <br /> <br />2.Encroachment Agreement – 7170 Shad Avenue, Fence <br /> <br />3.Encroachment Agreement – 1793 Center Street, Fence <br /> <br />4.Successful Performance Review Ms. Kris Sweeney, Senior Account Clerk (Grade 6 <br />from Step 8 to Step 9): Completion of Year 16 <br /> <br />5.Res. #16 – 021 – Identifying the Need for Funding to Complete its 2040 <br />Comprehensive Plan Update & Authorize an Application for Planning Assistance <br />Grant Funds <br /> <br />Mayor Wilharber provided an opportunity to Council Members for removal of any items of <br />concern. <br /> <br />Motion by Council Member Love, seconded by Council Member Paar to Approve Consent <br />Agenda as presented. All in favor. Motion carried. <br /> <br />VII. OLD BUSINESS <br /> <br /> <br />1.Home Detail, Inc. – Purchase of 7261 Main Street <br /> <br />a.Res. #16 – 022 – Approving the Sale of Land Lot 14, Block 2, Burque <br />Addition No. 1, Anoka County, Minnesota, at Postal Address 7261 Main <br />Street, Centerville, MN <br /> <br />Attorney Glaser stated that Council has dealt with this item previously and that a title issue was <br />brought to light along with financing issues. He reported that Mr. Magdik is again requesting an <br />amendment to the purchase agreement allowing for closing on the property on the following <br />Tuesday. Attorney Glaser stated that he has built in figures covering the estimated building <br />permit fee and his fees for the additional work. Council Member Fehrenbacher stated that he is <br />pleased that Mr. Magdik is still interested and willing to work with the City but a penalty should <br />be imposed if closing fails due to Mr. Magdik’s part as this has lasted too long without a home <br />being built on the property. Mr. Magdik did explain that the title issue was no fault of his and <br />Kurt stated that it was taken care of in a short period of time and involved a death certificate. <br /> <br />Attorney Glaser stated that he felt $150 was sufficient for the additional work needed to rewrite <br />the agreement and that Mr. Magdik has paid taxes as if a home were on the property to the City <br />Page 3 of 7 <br /> <br /> <br />
