City of Centerville <br />Council Meeting Minutes <br />October 12, 2016 <br />Discussions have taken place with Mr. Brass and he has agreed to the added language and <br />commission distribution. <br /> <br />Motion by Council Fehrenbacher, seconded by Council Member Paar to Approve the <br />Submitted Brokerage Agreements as Presented. All in favor. Motion carried. <br /> <br /> <br />2.Planning & Zoning Commission Denial to Recommend to Council Approval of <br />Variance Request – 7261 Main Street <br /> <br /> <br />a.Consideration of Findings of Fact <br /> <br />Administrator Ericson stated that the Planning & Zoning Commission considered this item at its <br />October 4, 2016 meeting where City Attorney Glaser submitted Findings of Fact associated with <br />the variance request. Lengthy discussion took place regarding two previous variance approvals, <br />precedence for encroaching within the lake setback, requirements associated with the lake <br />setback, not meeting hardship requirement (lack of own doing), legal requirements, <br />accommodations previously provided to the owner and DNR regulations. <br /> <br />Mr. Jeff Magdik, Home Detail, Inc., stated that he desired to construct a home that would not <br />only increase the usability of the lot but provide an esthetically pleasing home that would take <br />advantage of the lakeshore. Mr. Magdik stated that the original variance was completed without <br />building plans and was not surveyed prior to purchase. He stated that he is not requesting but 1’ <br />to 5’ encroachment for a deck on the lake side and feels that such a request should be allowable. <br /> <br />Lengthy discussion took place regarding law, the lack of meeting all requirements for issuance of <br />a variance, setting precedence, the proposed building size and square footage, the Council’s <br />desire for a home to be constructed on the lot, alternative option(s) for building size that could be <br />utilized by Mr. Magdik, requirements of the DNR, RCWD and Council’s willingness to work <br />with Mr. Magdik for four years and his lack of preparation and requirements of his existing loan. <br />Administrator Ericson stated that he, City Attorney Glaser and Public Works Director Palzer <br />would be eager to meet with Mr. Magdik the following morning to discuss alternative options if <br />he desired. <br /> <br />Motion by Council Member Love, seconded by Council Member Fehrenbacher to Re- <br />Affirm the Planning & Zoning Commission’s Recommendation, and Adopt the Findings of <br />Fact as Submitted. (4/1) Mayor Wilharber opposed. Motion carried. <br /> <br />VIII. NEW BUSINESS <br /> <br /> <br /> <br />1.Proclamation – Minnesota/Centerville Manufacturing Week <br /> <br />Administrator Ericson stated that the submitted proclamation is similar to last year and symbolic <br />to manufacturers with recognition and importance to the economy in the State of Minnesota.
