<br />presentation of documentation of such expenses in a form <br />prescribed by the Employer, which shall include satisfactory third <br />party evidence of the amount of the expense and the date(s) <br />incurred. In addition, upon presentation of a claim, a Participant <br />shall expressly represent that the item for which a claim is made is <br />not subject to reimbursement under any policy described in <br />paragraph 5.2.2(d) or from any other source. In its discretion, the <br />Employer may pay any of such expenses directly, in which event it <br />shall be relieved of all further responsibility with respect to that <br />particular expense. These expenses shall be paid periodically <br />during the Plan Year upon receipt during the prior month of a <br />claim complying with Plan requirements and by March 15 <br />following the close of the Plan Year upon receipt no later than <br />February 28 of a cl~im.CQllilplying WW)BlflI11;equirements. <br />(d) Limitations on Health Care Reimbursement <br />Benefits. Anything in the Plan to the contrary notwithstanding, no <br />Participant shall be entitled to benefits under this paragraph 5.2.2: <br />(i) In the event and to the extent that, the <br />reimbursement or payment is covered under any insurance <br />policy or policies, whether paid for by the Employer or the <br />Participant, or under any other health and accident plan by <br />whomever maintained. If there is such a policy or plan in <br />effect providing for reimbursement or payment, in whole or <br />in part, then to the extent of the coverage under that policy <br />or plan, the Plan shall be relieved of any liability; or <br />(ii) To the extent that the expense has been <br />submitted for reimbursement from the Participant's <br />Dependent Care Reimbursement Account or under any <br />similar program or plan maintained by some other person <br />or entity. <br /> <br />16 <br />
