<br />City of Centerville <br />Council Meeting Minutes <br />December 19,2002 <br /> <br />Council Member Capra indicated the Lifetime Achievement Committee had voted to <br />award Mr. Robert LaMotte a lifetime achievement award for 2002 and Mr. Wayne <br />LeBlanc a lifetime achievement, special recognition award. <br /> <br />Motion by Council Member Nelson, seconded by Council Member Capra to confirm <br />the Lifetime Achievement Award Committee's recommendations. All in favor. <br />Motion carried unanimously. <br /> <br />Council Member Capra indicated the awards would be presented at the end of January. <br /> <br />4. EDC Request for Per Diem Payment <br /> <br />Council Member Broussard Vickers commented that Council had already agreed the <br />Committee would be paid per diem but no one gets per diem if there is no quorum. <br /> <br />Ms. Moore-Sykes indicated that the Committee desires to donate its per diem back to <br />programs. Council Member Nelson indicated members would need to take the per diem <br />and then give it as a donation. <br /> <br />Mayor Swedberg indicated it would create an awkward/situation and said members need <br />to take the per diem. <br /> <br />Ms. Moore-Sykes indicated the most important question was whether they would be paid <br />if there were no quorum. <br /> <br />Council Member Nelson indicated that Staff should instruct them that they should not be <br />conducting a workshop when there is no quorum as they are breaking the open meeting <br />laws. City Attorney Hoeft indicated there is no violation of the open meeting laws if <br />there is no quorum. <br /> <br />5. Resolution #02-068 - Cable <br /> <br />Council Member Capra indicated the resolution would allow the Cable Commission to <br />bond to construct a building. <br /> <br />City Attorney Hoeft indicated he had reviewed the document and relies on the expertise <br />of Mr. Creighton who drafted it for the appropriateness of the language. He then <br />cautioned Council that approval of the resolution places the City on the hook for $89,000 <br />which will have to be repaid regardless of whether the City opts out of the Commission. <br /> <br />Council Member Broussard Vickers clarified that the City cannot be held responsible for <br />other defaults. City Attorney Hoeft verified that the City would only be responsible for <br />Centervi11e's portion ofthe bonding. <br /> <br />Council Member Broussard Vickers asked what other option the City would have. City <br />Attorney Hoeft indicated the City has no option if it desires to continue cable service. <br /> <br />Page 8 of 15 <br />
