Plat shall be revised reduce the size of Outlot A to allow reasonably direct <br /> access to LaValle Drive for Mr. and Mrs. Zimney, so that this driveway may be <br /> straighter. <br /> 8) The developer shall address all comments of the Centerville Public Works Department, City <br /> Engineer, and Public Safety officials to their satisfaction. <br /> Some condition would apply. <br /> 9) The City will consider further reduced front setbacks for structures to the right-of-way on <br /> new LaValle Drive if necessary to achieve other conditions in this approval. <br /> The current plan has the some structure locations and setbacks as the previous <br /> plan. <br /> FINDINGS OF FACT <br /> If the Planning Commission recommends approval of the requests, the following Findings of Fact <br /> would support that decision: <br /> 1) Comprehensive Plan amendment: <br /> a. The property is currently guided for residential development and the proposed land <br /> use plan amendment would be a reasonable use for this area, reducing the <br /> anticipated density while provideding needed housing and economic <br /> development for the City. <br /> b. The amendment to Low Density Residential is appropriate for the area and fits the <br /> developer's intentions. <br /> 2) Rezoning <br /> a. The property is currently zoned B-1 Commercial and R-3 High Density Residential. <br /> Rezoning to R-2A is reasonable for the area and consistent with the land use plan <br /> amendment being requested. <br /> 3) Conditional Use Permit for a Planned Unit Development (PUD): <br /> a. The proposed project meets the intent of the City's PUD code: <br /> i. It is consistent with the Comprehensive Plan, as amended for the project; <br /> ii. The project is a unified treatment of the site and deals responsible with the <br /> lake shore and wetlands on site; <br /> iii. The project harmonizes with surrounding properties in terms of land use, <br /> property access and scale of development; <br /> iv. The project will be developed as one unit under a homeowners association, <br /> including the shoreland which will be in common ownership; <br /> v. The project will be provide common storm ponding areas and lakeshore <br /> easements that are balanced with the overall project; <br /> vi. The new 18 units would not create an excessive burden on City services. <br /> vii. The project will be a desirable environment within its boundaries; <br /> viii.
