City of Centerville <br /> Council Meeting Minutes <br /> July 25,2018 <br /> Motion by Council Member Love, seconded by Council Member King to Approve the <br /> as submitted. All in favor. Motion carried. <br /> IX. NEW BUSINESS <br /> 1. Variance Request for 1965 South Robin Lane <br /> a. Findings of Fact <br /> b. Res. #18-OXX—Authorizing Variance <br /> Mark stated owners/developers here and before P & Z variance garage for driveway, garage not <br /> built with building and driveway can not sqeeze 9 is less variance for chunck of land until <br /> 14' between house and property line some reasons found to be good candidate neighbor <br /> is a park and not effecting anything, passive part of park and fact lot and many in <br /> neighborhood need garages and reasonable use of property and no other place to put <br /> garage and driveway. Next two properties also have garages in rear. King not sure how <br /> get to garage or where to put it. Love questioned utilities. Mark stated encroachment <br /> along with this and some sort of utilitiy down line go through park. Love since our land <br /> up against do we seed footage. Variance has to be not created by land owner and they are <br /> building garage. Kurt we allow accessory structures and everyone has a garage and allow <br /> property owners to reasonably utilize their property. Kurt what is different is you could <br /> fit a whole driveway on other lots and plat that we approved and we should not have <br /> approved and City caused while plating and did not create we gave them odd sized lot. <br /> Doug Kruse and permit granted by City and 2' variance and get back to the garage. Love back <br /> of their lot and no screening to businesses and very interesting and see straight through <br /> and think businesses should have screening. Mark larger discussion on code enforcement <br /> and most not allowed under code. Mark revisit code enforcement both residential and <br /> business and not anti-business and tricky and help eda through that. Code enforcement <br /> can be Council and staff and want to discuss strategies and p & Z if do something <br /> different and ordinance antiquated. Mark commercial code enforcement and viewed as <br /> antibusiness and hard enforcement and businesses will say that and eda strategies with <br /> that and would like to share with EDA. Screening and whether or not required and if not <br /> there before and it may not be required to add screening. Russ P & Z healthy discussion <br /> not created by landowner and if not variance and straiten property line and sell part of <br /> park and sell to them. P & Z reasonable and gave a permit and now tell cant get back <br /> there. Kurt helped draft documents and P & Z on board. King because on property line <br /> and if City has anything to do to disrupt their driveway and future protection for <br /> driveway and notice to new homeowner and City not come in do something to that. Kurt <br /> nature of variance takes care of both issues. Written and defined and recorded with <br /> property and then we do something against that it would be eminent domain. Love fence, <br /> Mark they would need encroachment agreement and along there there is a chain link <br /> fence.
