City of Centerville <br /> Council Meeting Minutes <br /> August 8,2018 <br /> meet those guidelines. He stated that at submittal, factors of additional lots were not <br /> contemplated. However, the developer has since reconsidered the potential for relocation/or <br /> modification of roadway(s) within the development allowing for this. He stated that the P & Z <br /> Commission recommended approval of a through road from Revoir to Old Mill Road and two <br /> (2) additional public roadways which would be cul de sacs. <br /> Lengthy discussion ensued regarding trail connection throughout the development to Acorn <br /> Creek Park and sidewalks, drainage, overland drainage, installation of additional drain the if <br /> determined to be needed, emergency overflow (EOF) and potential for not working <br /> appropriately, inlet/outlets, Developer's Agreement, securities, infrastructure liabilities, <br /> mechanisms for building sizes, quality of homes along with values, preliminary plat being <br /> approval of design and layout for minimal change when filing for final plat. Administrator Statz <br /> also reported that with the development a parking lot for Acorn Creek could be constructed. <br /> Motion by Council Member Love, seconded by Council Member Koski to Approval <br /> Preliminary Plat and Rezoning of 7384 & 7396 Old Mill Road as Presented. All in favor. <br /> Motion carried. <br /> 2. Letter of Credit Policy <br /> Administrator Statz stated that City Code addresses securities/Letters of Credit (LOC) but is <br /> unclear regarding reductions and releases of same. He stated that approximately 90% of the <br /> LOC is for infrastructure within the development and the remainder if for grading, landscaping, <br /> etc. Attorney Glaser stated that the policy was drafted in place of amending the code as code is <br /> law and a policy allows for situational variations. Administrator Statz stated that the policy is a <br /> tool for developers, aiding them in receiving reductions upon finishing the project in phases <br /> allowing them to secure additional securities for other projects. <br /> Discussion took place regarding monthly requests for reductions which could be <br /> extreme/unwarranted and time-consuming and that the developer should have an appeal <br /> opportunity before Council. <br /> Motion by Council Member Montain, seconded by Council Member Love to Adopt the <br /> Letter of Credit Policy 4. c. to Include "The Recommendation of Staff may be appealed to <br /> the Council". All in favor. Motion carried. <br /> X. COUNCIL/ADMINISTRATOR ANNOUNCEMENTS <br /> Administrator Statz stated that he emailed his Administrator's Report the previous day and he <br /> would be available to discuss any issues Council desired. <br /> He stated that the Public Works Department recently repaired a storm water pond that was <br /> leeching water through a berm which nearly empting the pond rather than holding the water. <br /> Page 3 of 5 <br />
