City of Centerville <br />Council Meeting Minutes <br />May 10, 2006 <br />Motion by Council Member Lakso, seconded by Council Member Paar, to approve <br />the Encroachment Agreement for bridge in easement with the understanding that <br />the City maintains access to the City meter. All in favor. Motion carried <br />unanimously. <br /> <br />nd <br />7. Request to Construct Fence in Easement 1986 72 Street (Burke-Michalek) <br /> <br />Motion by Council Member Terway, seconded by Council Member Paar, to <br />nd <br />approve the Encroachment Agreement for fence in easement for 1986 72 Street <br />with condition that access is maintained to the water meter for reading. All in <br />favor. Motion carried unanimously. <br /> <br /> <br />8. Special Event Permit Application – Kelly Miller Circus <br /> <br />Motion by Council Member Lee, seconded by Council Member Paar, to approve the <br />Special Event Application Permit for Kelly Miller Circus. All in favor. Motion <br />carried unanimously. <br /> <br /> 9. Planning and Zoning Commission’s Recommendations for Downtown <br />Redevelopment <br /> <br /> a. Resolution #06-029 – Downtown Redevelopment Comp Plan Amendment <br /> <br />Council Member Terway explained that this would add an M-2 District in certain <br />areas of downtown and there was discussion of a small area in the northwest <br />quadrant that was removed from the M-2 zone. Staff then showed on the screen <br />the location being discussed. <br /> <br />Mayor Capra asked if there would be an issue with spot zoning. City <br />Administrator Larson indicated that Staff does not feel there would be an issue. <br />The City Attorney agreed. <br /> <br />City Administrator Larson provided an explanation of the proposed changes to the <br />M-1 district and the addition of the M-2 district. <br /> <br />Council Member Lee said that he feels what is in the plan is too black and white <br />and it concerns him that this could be considered spot zoning. <br /> <br />Council Member Terway indicated the Planning Commission looked at the plan <br />for downtown and what needed to be done to ensure success of the plan. He then <br />said that the only objection was the one discussed that was not recommended to <br />be changed to M-2. <br /> <br />Page 5 of 10 <br />
