We assume all business operations, equipment and materials will be handled within the <br /> building. <br /> RECOMMENDATION <br /> Conditional Use Permit <br /> The Zoning Code has specific criteria in 156.320(B)(2) for granting a Conditional Use Permit: <br /> a) That the proposed building or use at the particular location requested is necessary or desirable to <br /> provide a service or a facility which is in the interest of the public convenience and will contribute to <br /> the general welfare of the neighborhood or city; <br /> b) That the proposed building or use will not have a substantial or undue adverse effect upon adjacent <br /> property, the character of the neighborhood, traffic conditions, utility facilities and other matters <br /> affecting the public health, safety and general welfare; and <br /> c) That the proposed building or use will be designed, arranged and operated so as to permit the <br /> development and use of neighboring property in accordance with the applicable district <br /> regulations. <br /> There are a few elements of the project that relate to the use itself that are appropriate to <br /> consider in granting a Conditional Use Permit or that are specifically noted in the code. <br /> We recommend that the Planning and Zoning Commission recommend approval of a Conditional <br /> Use Permit for Midwest Best Water with the following conditions: <br /> 1) Applicant and its tenants shall utilize the interior of the building. The Applicant and its <br /> tenants will produce no noise, vibrations, air pollution, light pollution, fire hazards or noxious <br /> emissions which will disturb or endanger neighboring properties. <br /> 2) Applicant shall store all parts, equipment, etc., associated with their businesses) within the <br /> building at all times. <br /> 3) The reduced number of parking spaces, 52 vs. the required amount, is approved provided <br /> the applicant submits a narrative explaining the anticipated use of the facility and the <br /> parking needs; and that if, in the opinion of the City Administrator, there are parking <br /> problems at the site the building owner will be required to add parking spaces or otherwise <br /> address the issue. <br /> I 1g ri v'1lI t i r r rrd <br />
