City of Centerville <br />Council Work Session & Council Meeting Minutes <br />May 22, 2019 <br /> <br />Motion by Council Member Montain seconded by Council Member Lakso to Adopt Ord. <br />#97 Revising Language to Strike the Changes 156.030, L, Subdivision 3 Which was Struck <br />Out and Changed Over with 4 Building Supply Sales and All Proposed Changes to Building <br />Supply Sales Should be Struck from Ord. #97 and be Adopted. All in favor. Motion carried. <br /> <br />Mayor Paar thanked the Shuda’s and Mr. Beck for participating in the meeting and stated that the <br />City would continue to work with them regarding their issues. <br /> <br />b. Ord. #98, Second Series (Second/Final Reading) – Rezoning Certain <br />Properties from B-1 to B-2 <br /> <br />Administrator Statz stated that this item specifically speaks of the properties that would be rezoned <br />th <br />along Main Street and 20 Avenue. He stated that these properties would also be affected by Ord. <br />#97 regarding regulations in those zoning districts. <br /> <br />Discussion ensued regarding businesses that could become non-conforming by this action and the <br />ramifications. It was stated that the City had spoken with that business owner/operator who did <br />not believe it would be an issue. Attorney Glaser stated that if that individual sold the business <br />within a years’ time to a similar operation it could remain in operation with the non-conformity. <br />He also stated that if there is a conditional use permit that it stays with the land until such time as <br />another is issued or it expires due to lack of operation. <br /> <br />Motion by Council Member Koski, seconded by Council Member Love to Adopt Ord. #98, <br />Second Series – Rezoning Certain Properties from B-1 to B-2 as presented. All in favor. <br />Motion carried. <br /> <br />2. Bay View Villas <br />a. Ord. #99, Second Series (Second/Final Reading) Adopting Revisions to <br />Bayview Villas Conditional Use Permit for a Planned Unit Development <br /> <br />City Attorney Glaser stated that the only modification that has been made is to allow pools on one <br />lot within the development. <br /> <br />Brief discussion was had addressing keycard access which Attorney Glaser stated was in additional <br />document (Developer’s Agreement) but not a part of the Conditional Use Permit. <br /> <br />Motion by Council Member Love seconded by Council Member Lakso to Adopt Ord. #99, <br />Second Series – Adopting Revisions to Bayview Villas Conditional Use Permit for a Planned <br />Unit Development as presented. All in favor. Motion carried. <br /> <br /> b. Declaration of Covenants, Conditions and Restrictions for Bayview Villas <br />Bay View Villas Homeowner’s Association Documents <br /> <br />City Administrator Statz stated that action only needed to be taken on items a. and c. as Res. #19- <br />013 incorporated Item b. City Attorney Glaser stated that the documents address common land <br />and structuring of the Homeowner’s Association to protect the City’s interests and place <br />requirements on an entity but if the entity fails, the City will step in. <br />Page 4 of 10 <br /> <br /> <br />
