City of Centerville <br />Council Work Session & Council Meeting Minutes <br />May 22, 2019 <br /> <br />Lengthy discussion was had regarding a previous developer allowing outlots to be tax forfeited <br />due to the developer’s unwillingness to take care of, pay property taxes or to establish a <br />homeowner’s association. City Administrator Statz stated that the developer does not hold a <br />homeowners association, it is organized and operated by the benefiting property owners. <br /> <br />Ms. Gloria Hartman, 5795 Hobe Lane, White Bear Lake stated that she was interested in <br />purchasing Lot 4 but under the landscape plan and visually inspecting the lot it appears that there <br />is standing water in the rear of the property close to the lake. City Administrator Statz stated that <br />there was a section between the lake and lots for a rain garden with riprap. City Attorney Glaser <br />stated that the developer/realtor Mr. Jim Boo was in the audience and that Ms. Hartman could <br />address her concerns to him as the discussions this evening did not involve drainage, site plans, <br />etc. Mayor Paar stated that the Council discussed the landscaping plan in depth regarding the <br />lakeshore and a 30’ buffer zone. <br /> <br />Mr. Jim Boo, Developer for Bayview Villas, thanked Staff and Council for working diligently on <br />all documents and challenges along the way to get to this point. Mayor Paar thanked Mr. Boo for <br />his efforts also. <br /> <br />c. Resolution #19-012 – Adoption Final Plat & Development Agreement <br /> <br />City Attorney Glaser stated that the change was because Mr. Rich DeFoe has formed an LLC and <br />the documents need to reflect that. <br /> <br />Motion by Council Member Love seconded by Council Member Koski to Approve Res. #19- <br />013 – Adoption of Final Plat & Development Agreement Associated with Bay View Villas as <br />presented. All in favor. Motion carried. <br /> <br />3. Old Mill Estates <br />a. Res. #19-013 – Adoption Final Plat & Development Agreement <br /> <br />City Administrator Statz stated that this adoption and agreement are less complicated than the <br />previous agreements as the development is not a Planned Unit Develop, meets zoning code and <br />has no homeowner’s association. He stated that final place covers phase 1, master agreement and <br />an amendment to add phase 2 working under the umbrellas of phase 1. Brief discussion was had <br />regarding Acorn Creek Park parking, trail extension, sidewalks and utilizing the developer’s <br />contractor to construct these additional amenities at the City’s expense. City Administrator Statz <br />also stated that the funding for these amenities would come from the Parks capital fund. <br /> <br />Motion by Council Member Montain, seconded by Council Member Koski to Adopt Res. <br />#19-013 – Adoption Final Plat & Development Agreement for Old Mill Estates Development <br />as presented. All in favor. Motion carried. <br /> <br />Mayor Paar requested that the page numbers be placed on the Agenda for ease of location of <br />items within the packet. <br /> <br />4.
