January 22, 2020 <br />Centerville City Council <br />Page 2 of 6 <br />Atlas Villas Memory Care - Interim Use Permit & Site Plan Approval <br />PLANNING ISSUES <br />The discussion among City staff, the City Attorney and the Planning & Zoning Commission has <br />focused on several issues: <br />1) The potential impact on emergency services associated with this type of facility. <br />2) The ability of the applicants to reasonably handle falls and other non -emergency issues, <br />which would depend on the number of staff, the level of staff training, adequate <br />equipment and facilities on site to handle various situations, and policies in place to <br />address these issues. There are attachments in the City Council packet detailing various <br />policies and procedures involved. <br />3) Screening and landscaping of the facility to neighboring properties, lighting, parking, and <br />exterior building materials. <br />4) The process involved - an Interim Use Permit first, so that the City can review the facility's <br />operations and experience over a period of time, followed by the opportunity for the <br />applicants to apply for a Conditional Use Permit. <br />RECOMMENDATIONS <br />The recommendations below for the Interim Use Permit Conditions and Findings of Fact are also in <br />the draft Interim Use Permit prepared by the City Attorney, in the City Council packet. <br />Interim Use Permit <br />I recommend that the City Council approve the Interim Use Permit (IUP) for the Atlas Villas Memory <br />Care project at 825 Main Street with the following conditions, which follow closely the Planning & <br />Zoning Commission recommendation: <br />1) Landowner will obey all laws and regulation necessary to operate this type of facility, and <br />will obtain and maintain, in good standing, all licenses necessary to operate this type of <br />facility. <br />2) The facility will have a sufficient number of trained personnel at the facility at all times who <br />are capable to perform lift assists and will follow protocol discussed in Policy 2.05 Fall <br />Protocol submitted with the CUP application. The facility will also comply with additional <br />emergency policies submitted with the application including policy 1.19 and 2.04. <br />3) Users of the Subject Property will produce no noise, vibrations, air pollution, light pollution, <br />fire hazards or noxious emissions which will disturb or endanger neighboring properties. <br />4) Users of the Subject Property will create no act of public nuisance or disorderly conduct, as <br />defined pursuant to the City's Code of Ordinances or pursuant to State Law. <br />„Ig wffl"l it rnlrr�Wi; <br />
