January 22, 2020 <br />Centerville City Council <br />Page 4 of 6 <br />Atlas Villas Memory Care - Interim Use Permit & Site Plan Approval <br />16) Once licensure to operate a 16-unit senior living/memory care facility on the Subject <br />Property has been granted and the facility begins operations after accepting its first <br />patient, the Landowner may apply for a Conditional Use Permit from the City to operate <br />that facility. The Landowner must make this application within one-year of the date the <br />licensure has been fully granted. Failure to make timely application voids the Interim Use <br />Permit. <br />17) This Interim Use Permit is not transferrable to another party without the written approval and <br />consent of the City Council. <br />Findings of Fact for Interim Use Permit <br />I recommend the City Council adopt the following Findings of Fact in support of the IUP: <br />1) The proposed Atlas Villas Memory Care facility is an appropriate use for the City's Main <br />Street Commercial District as a specialized care facility use. <br />2) The addition of a memory care facility in this location benefits the general welfare of the <br />neighborhood and City. <br />3) The City's expectation for high quality, durable building materials is reasonable to protect <br />the investment and character of its business districts. <br />4) The proposed Atlas Villas Memory Care facility is required to operate pursuant to licensure <br />granted by the State of Minnesota and Anoka County. The facility has not yet obtained <br />that licensure. The City's expectation is that the facility will comply with applicable law, <br />regulation, and licensure necessary to operating the facility, as well as additional <br />operating conditions set by the City which are reasonable to ensure that the facility is not <br />an undue burden on public emergency services. <br />5) Memory care and assisted living facilities similar to the proposed facility can be associated <br />with an increased number of calls for emergency public safety services. This type of patient <br />population has greater needs for medical services and are at a greater risk for injury. <br />6) The applicant proposes to operate a 16-unit senior living/memory care facility. The <br />relatively small size of this facility means the business model will employ less staff than would <br />a larger facility. With less staff at the facility to address patient matters, the facility's staff <br />may need to call 911 for support. Any assisted living facility will proportionally increase calls <br />for emergency services simply due to the type of patient population served by these <br />facilities. However, the City should be concerned with the potential for increased costs for <br />emergency services if 911 calls were used to supplement the applicant's facility staffing. <br />7) It is reasonable for the City to place operating conditions on the facility to ensure that an <br />increase in emergency service is the responsibility of the applicant, and not the City. <br />„Ig wffl"l it rnlrr�Wi; <br />
