April 6, 2021 <br />Centerville Planning & Zoning Commission <br />Page 3of 9 <br />RE: NorBella Senior Living – Rezoning, Conditional Use Permit, Site Plan Review <br />REQUESTS <br />Rezoning <br />The request is to rezone the parcel from B-2 to B-1, as illustrated below. The Land Use Plan <br />designation of Commercial would not change – both districts correspond to the C designation on <br />the Land Use Plan. When the B-2 district was created recently it was intended to regulate uses on <br />Main Street, with B-1 for other commercial properties off Main Street. Since the original larger <br />Rehbein parcel fronts Main Street it was all zoned B-2, even though the NorBella lot and other <br />parcels are some distance from Main Street. The NorBella site is 550-600 ft north of Main Street. <br /> <br />Conditional Use Permit <br />A Specialized Care Facility is a Conditional Use in the B-1 district, defined in the Zoning Code as “A <br />state-licensed care facility which is not otherwise specifically defined or regulated elsewhere in this <br />chapter.” The facility will require state licenses for assisted living and memory care. If the rezoning <br />is approved, the proposed NorBella facility would be allowed with a CUP. <br /> <br />The issues associated with this type of facility involve having the appropriate license(s) from the <br />State and County; having adequate staff to handle emergencies involving residents, such as falls; <br />and having a plan in place to followed in case of emergencies, with the City being able to assess <br />the owners for excessive use of emergency services. These conditions and findings are detailed <br />later in this report and in the City Attorney’s draft CUP. <br /> <br />A CUP must meet the criteria in Section 156.320 of the Zoning Code – basically that the use is <br />necessary and desirable; that it will not adversely impact the neighborhood; and that it is <br />designed to allow development of neighboring property. The proposal meets these criteria. <br /> <br />
