April 6, 2021 <br />Centerville Planning & Zoning Commission <br />Page 7of 9 <br />RE: NorBella Senior Living – Rezoning, Conditional Use Permit, Site Plan Review <br />Conditional Use Permit <br />I recommend approval of the Conditional Use Permit for the NorBella Senior Living facility as <br />proposed, with the following conditions: <br />1) Landowner will obey all laws and regulation necessary to operate this type of facility, and <br />will obtain and maintain, in good standing, all licenses necessary to operate this type of <br />facility. <br /> <br />2) The facility will have a sufficient number of trained personnel at the facility at all times who <br />are capable to perform lift assists and will follow protocol and licensure requirements. <br /> <br />3) Residents and users of the facility are encouraged to call for emergency services provided <br />by the City and other governmental agencies. The facility will operate pursuant to a plan, <br />approved by the City, to manage the facility’s consumption of these emergency services, <br />as detailed in the Conditional Use Permit prepared by the City Attorney. <br /> <br />4) Users of the facility will create no act of public nuisance or disorderly conduct, as defined <br />pursuant to the City’s Code of Ordinances or pursuant to State Law. <br /> <br />5) The trash/storage enclosure will be screened as depicted on the landscape plan. <br /> <br />6) Signage for the project will be reviewed and approved by the City Planner. <br /> <br />7) Users of the site will produce no noise, vibrations, air pollution, light pollution, fire hazards or <br />noxious emissions which will disturb or endanger neighboring properties. <br /> <br />8) Landowner will follow the applicable standards and requirements of the City of Centerville <br />City Code, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, <br />Minnesota Department of Natural Resources, and any other agency having jurisdiction <br />over the Subject Property and shall secure those same files with the City. <br /> <br />9) Landowner will construct and maintain the Subject Property and improvements contained <br />thereon, in accordance with the Site Plan and Building Plans as approved by the City. <br /> <br /> <br /> <br />
