April 6, 2021 <br />Centerville Planning & Zoning Commission <br />Page 9 of 10 <br />RE: Belleville Landing Apartments – Land Use Plan Amendment, Rezoning, PUD/CUP, Site Plan Review <br />3)Users of the site will produce no noise, vibrations, air pollution, light pollution, fire hazards or <br />noxious emissions which will disturb or endanger neighboring properties. <br />4)Landowner will follow the applicable standards and requirements of the City of Centerville <br />City Code, Rice Creek Watershed District, Anoka County, Army Corp of Engineers, FEMA, <br />Minnesota Department of Natural Resources, and any other agency having jurisdiction <br />over the Subject Property and shall secure those same files with the City. <br />5)Landowner will construct and maintain the Subject Property and improvements contained <br />thereon, in accordance with the Site Plan and Building Plans as approved by the City. <br />Suggested Findings of Fact for Approvalof the Conditional Use Permitfor the Planned Unit <br />Development: <br />5)The proposed Belleville project is an appropriate use for the R-3 district. At 19.4 units/acre it <br />meets the City’s density range of 12-15 units/acre. <br />6)The proposed use fills a need in the City for additional multi-family housing in a location <br />that is served by major roadways, commercial goods and services, and transit. <br />7)The proposed use will not negatively impact surrounding uses or inhibit development of <br />surrounding properties. <br />8)The project is well designed and attractive. <br />9)The project meets the criteria for increased setbacks to mitigate increased height of the <br />building from the 35-foot height limit in the Code to the proposed 48.5-foot height. <br />10)The project as proposed meets the criteria for granting a Conditional Use Permit in Section <br />156.330(C)(2) of the Zoning Code. <br />Site Plan Review <br />I recommend approval of the site plan for Belleville Landing apartmentsas illustrated on submitted <br />drawings from Carlson McCain dated 3-11-21, and from THAArchitects dated 3-11-21, with the <br />following conditions: <br />1)The developerwill consider additional sidewalk connections to the west and south as <br />illustrated in this report. <br />2)Parking will be provided as illustrated on the site plan, with two handicapped, accessible <br />spaces near the front entry. <br />3)Building materials and colors will be as illustrated on the submitted materials. <br /> <br />
