City of Centerville <br />Council Meeting Minutes <br />April 28, 2021 <br />of clarification about what happens if the plat is approved and nothing else. He explained that if <br />the developer did not record it and just sat there with approval of the plat in hand, that approval <br />would be good for one year and at that point, the Code and possibly State Statute, would allow for <br />the approval to be invalidated. <br />Mayor Love asked about the earlier comment Administrator Statz had mentioned about tabling <br />this item. <br /> <br />Administrator Statz stated that all of these items can be tabled within the timeframe of an additional <br />60 days, with the initial 60-day period ending sometime next week. He stated that would mean <br />the City would have essentially May and June to make a decision. He cautioned the Council that <br />if they want more time to look at this, he would advise that they not make a motion to deny the <br />request. <br />Mr. Carlson noted that he believes that Preliminary Plats have a 120-day deadline which is not the <br />same as other zoning approvals with a 60-day deadline. <br />City Attorney Glaser confirmed that this item would not need an extension because there is already <br />more time. He stated that if the Council chose to vote down the project, they would usually state <br />the reasons so it could be corrected and brought back to the City. He stated that the Council could <br />also just table this item because there is sufficient time with the 120-day rule, but they can also <br />pass it because it is a Preliminary Plat and it would be subject to further modification and final <br />approval. <br /> <br />The Council discussed the Preliminary Plat approval process, the street platting, easements, <br />utilities, drainage, and when things are recorded with the County. <br /> <br />Motion by Council Member Lakso, seconded by Council Member Koski, to Approve the <br />Preliminary Plat as Presented. <br />Council Member Koski explained that part of him wanted to look as this as a group but based on <br />what the consultants have shared, he understands that this is just a step and is just drawing property <br />lines and will help clean up the Lot 1 and Lot 1A issue. <br /> <br />Mr. Carlson noted that he would like to make sure that the conditions are included in the motion. <br /> <br />Motion amended by Council Member Lakso, second amended by Council Member Koski, to <br />Approve the Preliminary Plat with the conditions as included in the staff report. A roll-call <br />vote was taken. Mayor Love and Council Members King, Koski, Lakso & Mosher voted in <br />favor. Motion carried. <br />City Clerk Bender noted that there was a comment made that this would clear up the Abstract and <br />Torrens issue with two of the lots and clarified that she does not believe that Preliminary Plat will <br />take care of that issue. <br />Administrator Statz stated that one of the conditions that was just approved by the Council is the <br />requirement that it be cleaned up prior to Final Plat. <br />Page 10 of 26 <br /> <br />
