Sidewalks, trails and park dedication are <br />proposed for all lots and noted that the engineering items are covered separately in a memorandum <br />from the City Engineer. He stated that he believes it is important for this discussion, knowing the <br />interest in the proposed development, that dividing this plat into lots, can be approved as simply <br />the division of land as a stand-alone as action without approval of the specific uses. He noted that <br />Lot 2, Block 1 is the Kwik Trip lot, Lot 3, Block 1 has no proposed development, Lot 1, Block 2 <br />is the proposed senior living facility, and Lot 2, Block 2 is the proposed apartments. He stated that <br />th <br />the question is whether Street A should be extended to 20 if and when needed. He noted that he <br />had included some possible scenarios related to the street, but reiterated that the recommendation <br />is for a traffic study to be done to see what would happen if the entire plat were fully developed. <br />He reiterated that this plat meets the basic requirements for subdivision in the City Code and staff <br />is recommending approval. <br /> <br />Administrator Statz stated that the legal requirements in front of the Council for a Preliminary Plat <br />are that there is a duty for them to evaluate the proposal based on the CityÓs requirements. He <br />asked that the Council put aside everything else that is proposed as part of this and just look at this <br />as a subdivision of land by itself. He stated that if there is nothing wrong with the subdivision, as <br />a whole, there is an obligation to approve it. He stated that they can give feedback regarding to <br />things they do and do not like, such as proposing the roadway in a different location. He stated <br />that the Council could allow for an extension of another 60 days to allow for more time to review <br />but the Council cannot say that someone cannot plat their land. <br /> <br />Mr. Carlson stated that the drawing in the report that shows the colored lots is not the plat and <br />clarified that the plan does not identify proposed uses, such as Kwik Trip or the senior living or <br />apartments. The plat simply identifies Lot 1, Block 1, Lot 2, Block 1, etc. and the street right of <br />way and simply divides the land into parcels. The Preliminary Plat is one step in process and <br />would still need to be final and presumes this arrangement is approved and the landowner would <br />have certain rights if they bring back a final plat at a later date. <br /> <br />Attorney Glaser stated that this is a Preliminary Plat and there is a Final Plat that comes after that <br />and are another series of questions that relate to the individual developments within the lots. He <br />stated that the Council should really view those as independent questions and will be preliminary <br />because there will be more than one step associated with them which means there will be more <br />time built in to answer those questions. <br /> <br />Mayor Love gave the opportunity for representatives from Rehbein/R & R Leasing to speak the <br />item, but no one spoke. <br /> <br />Council Member King stated that he had no problem with the plat and noted that his one question <br />is what would happen if someone came in and wanted two lots instead of one, how much would <br />that process cost them to combine the lots. <br /> <br />Administrator Statz stated that if there were major changes, it would be brought back before the <br />Council for this same process, but if it was substantially the same it would not be brought back <br />and would just move to the Final Plat approval. He stated that regarding cost, it is really just a line <br />on a computer and believes the costs would be minimal because the change is just to the drawing. <br /> <br />Page 8 of 26 <br /> <br />
