City of Centerville <br />Council Meeting Minutes <br />February 9, 2022 <br /> <br /> <br />Administrator Statz reviewed the snow plow policy and related city code amendments that were <br />discussed at the previous meeting. He stated it was a little difficult to get a clear direction being <br />that there were varying opinions. First, make the trigger, a snow fall event consistent from trails <br />to streets by lowering the 3 inch snow fall amount to 1.5 inches. Second, was to have some level <br />of conformity in the City’s policy regarding clearing of trails and expectations of residents for <br />clearing of abutting sidewalks. He stated that at the previous meeting, he heard that bare pavement <br />was unrealistic. <br /> <br />He stated that the draft policy was included in the packet along with suggested code amendment <br />language for residents removing snow following an event. <br /> <br />Public Works Director Palzer stated that they do pre-deicing prior to an event and following the <br />event they wing back the snow and clear slush from the roadways. <br /> <br />As to the legal issues, Attorney Glaser stated that he appreciated their desire to soften the <br />enforcement rules, but when you have to go in front of judge they need to have a clear and clean <br />standard. He discussed other option that were not used 91.06 (public nuisance policy) in a text a <br />lot clearer and cleaner if it says, you have to remove everything to the pavement within 24 hours. <br />He stated that it is harder for a judge if there are gray areas for example: if they say they tried salt, <br />chisel, heat and snow blower. Administrator Statz suggested using other language such as to <br />consider (reasonable) snow and ice on public sidewalks and trails with a reasonable effort to <br />remove. Attorney Glaser stated that there is no way to enforce this and it often comes up in <br />different context as to what is reasonable. <br /> <br />A lengthy discussion ensued as to what was the appropriate level of snow on trails and sidewalks, <br />when the snow should be removed, defining the difference between trails and sidewalks, the legal <br />and liability issues that the City could endure. <br /> <br />Administrator Statz stated that this will be brought back to the next meeting for additional <br />discussion. <br /> <br />IX. Administrator/Engineer Report <br /> <br />Administrator Statz noted that the Administrator’s Report was included in the packet and that he <br />would be happy to answer any questions regarding it. He stated it was a team effort to get his report <br />completed. <br /> <br />nd <br />He reported that the 2 of the Skate/Sled nights was scheduled for Saturday, February 12, 2022 <br />from 6-9 and that the Public Work Department had been diligently working to buildup ice for the <br />event. <br />Page 3 of 7 <br /> <br /> <br />
