City of Centerville <br />Council Work Session & City Council Meeting Minutes <br />December 8, 2021 <br /> <br />Administrator Statz explained that you can only have one (1) grant open at a time. He stated <br />additional funding is generally available for future grants. He also stated that the sooner this grant <br />is processed is the sooner that the City can submit for another. <br /> <br />Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the <br />Submitted Grant Documents and Commence Sealing of Wells as Presented. All in favor. <br />Motion carried. <br /> <br />IX. NEW BUSINESS <br /> <br />1. Ord. #122, Second Series – 2022 Fee Schedule, (1 st Reading) <br /> <br />Administrator Statz stated that a public hearing was held earlier with robust discussion taking <br />place. He stated that the primary discussion was whether to increase the Storm Water Fee and to <br />offset that increase with a decrease in Water Fees. Administrator Statz stated that Council <br />previously discussed a program to increase Storm Water Fees by having a five (5) year program <br />of a 5% increase in the fee. <br /> <br />Consensus of Council was that each year the amount could be evaluated. <br /> <br />No action was taken on this item as it was the first reading. <br /> <br />2. Tobacco License Renewals – 2022 <br />a. Corner Express/Circle K (Tobacco) <br /> <br />Administrator Statz stated that generally this item would be a Consent Agenda item but due to a <br />compliance check failure it has been placed under New Business. Attorney Glaser stated that there <br />was a sale to an underage buyer. He explained that there are two (2) aspects: an Administrative <br />Fine or placing conditions on the renewed license. He stated that this was Corner Express/Circle <br />K’s first violation in ten (10) years and it seemed appropriate to administer a fine per Code. Which <br />has a graduated fine schedule. He stated that if Council desired to place additional conditions on <br />the license that this was the only time to do so. Attorney Glaser also stated that Corner <br />Express/Circle K had the ability to bring an appeal before Council. <br /> <br />Mayor Love asked if there was specific training that can be attended. Attorney Glaser stated that <br />CLPD could provide training on Checking IDs similar to liquor establishments. Council Member <br />King asked Corner Express was checking IDs and Attorney Glaser stated that we are not aware of <br />their practices. Administrator Statz stated that he believed that they had a scanner on site and that <br />the buyer must be 21 year old. <br /> <br />Discussion ensued that Council is not fining and that there could be action against the employee <br />and the license holder. Attorney Glaser stated that the questions is whether an educational seminar <br />would be beneficial to their employees and would you desire to place that as a condition on the <br />license. He also stated that the license could be suspended or terminated. <br /> <br />Discussion ensued regarding additional training and the costs be the penalty, condition as training <br />and why, importance of documenting the education, the appeal process is there for a reason, we <br />Page 10 of 15 <br /> <br /> <br />
