City of Centerville <br />City Council Meeting Minutes <br />November 9, 2022 <br />agreement with RCWD has to do with the appropriate paper work not being completed with the location <br />st <br />near Distribution Alternatives and the Rehbein property (now Amazon property) along 21 Avenue <br />associated with the construction/placement of a new culvert. He stated that the original engineers for <br />Ryan Companies did not complete the proper paperwork and that an old field culvert was replaced with <br />a new culvert and its relocation was not in the same spot but approximately 50’ from the previous <br />location. He stated that staff is working with Lino Lakes and the Ryan Companies, (City of Centerville <br />acting as the conduit to secure the modeling, appropriate paperwork and associated fees being paid by <br />those responsible for the original incompleteness). He stated that the agreement holds the City of <br />Centerville accountable due to the fact that the City is reasonable for this requirement/regulation and we <br />approve the paperwork as the responsible authority for managing the floodway with the Rice Creek <br />Watershed District being in charge of modeling and submission of document to FEMA. <br /> <br />Several additional questions were received from Council regarding impact, requirements, RCWD <br />involvement, fees, etc. Administrator Statz stated that he felt most of the questions had been answered <br />previously, this situation only impacted the Floodfringe area and that all would be taken care of as the <br />issue is agreeable to those that are involved and not the City of Centerville. <br /> <br />Motion by Council Member King, seconded by Koski to approve the Memorandum of Agreement <br />with Rice Creek Watershed District – Floodway Modeling as Presented. All in favor. Motion <br />carried. <br /> <br />2. Res. #22-0XX - Supporting a Jointly Submitted List of Candidates for Nomination <br />to the Rice Creek Watershed District Board of Managers <br /> <br />Administrator Statz explained some back history regarding RCWD’s decision in the past not to appoint <br />individuals brought before them from member cities. He stated that the City of Circle Pines sued over <br />the issue of appointment and prevailed at the MN Supreme Court. He stated that the member cities are <br />submitting a list of candidates that both represent the cities and on the county’s behalf. He stated that the <br />seats are up for election every three (3) years. <br /> <br />Motion by Council Member Koski, seconded by Council Member Mosher to Adopt Res. #22-030 <br />– Supporting a Jointly Submitted List of Candidates for Nomination to Rice Creek Watershed <br />District Board of Managers as submitted. All in favor. Motion carried. <br /> <br />3. Res. #22-0XX – Adopting Delinquent Municipal Utilities, Garbage & Nuisance/City <br />Abatement Services to County Property Tax Statements Payable 2023 <br /> <br />It was stated that the public hearing was held open to this point and not members of the public appeared <br />before Council regarding the issue. The hearing was closed by Mayor Love. <br /> <br />Motion by Council Member Koski, seconded by Council Member King to Adopt Res. #22-031 – <br />Adopting Delinquent Municipal Utilities, Garbage & Nuisance/City Abatement Services to County <br />Property Tax Statements Payable 2023 as submitted.
