Increasing the number of parking stalls from 93 to 106, as proposed, requires one <br />additional ADA space. <br />City Fire Chief <br />The Fire Chief did not provide comments. <br />Rice CreekWatershed District (RCWD) <br />Apermit will be required bythe RCWD prior to construction beginning on site. The applicant is required <br />to coordinate as needed. <br />Findings for Approval <br />CUP Standards <br />City Code Sec. 156.320(B) outlines the standards and conditions for conditional uses as follows: <br />(1)A Conditional Use Permit may be granted for the following uses only: <br />a.Any use specifically listed as a Conditional Use in the regulations applicable to the <br />district in which it is to be located or otherwise stated in this Chapter to be a conditional <br />use; <br />b.Any use which is the same or similar, and consistent with, a conditional use specified in <br />the use district, the Planning Commission may consider and allow such conditional use. <br />(2)A Conditional Use Permit shall be granted only if evidence is presented to establish: <br />a.That the proposed building or use at the particular location requested is necessary or <br />desirable to provide a service or a facility which is in the interest of the public <br />convenience and will contribute to the general welfare of the neighborhood or city; <br />b.That the proposed building or use will not have a substantial or undue adverse effect <br />upon adjacent property, the character of the neighborhood, traffic conditions, utility <br />facilities and other matters affecting the public health, safety and general welfare; and <br />c.That the proposed building or use will be designed, arranged and operated so as to <br />permit the development and use of neighboring property in accordance with the <br />applicable district regulations. <br />CUPAmendment and Site Plan Approval Findings <br />Staff suggest the following regarding the CUP Amendmentand Site Plan Reviewrequests: <br />1.That the applicant has submitted requests to the City of Centerville for a Conditional Use Permit <br />(CUP) Amendmentand site plan reviewin accordance with the procedures as established by <br />/ĻƓƷĻƩǝźƌƌĻƭ /źƷǤ /ƚķĻ ğƓķ tƌğƓƓźƓŭ ğƓķ ƚƓźƓŭ /ƚƒƒźƭƭźƚƓͳ ğƓķ <br />2.That the request isto allow for modifications to the current conditions of approval in order to <br />permit abuilding expansion and associated site improvements; and <br />3.That the proposed use will remain a truck terminalͲ Ǟŷźĭŷźƭ ğƓ ğƦƦƩƚƦƩźğƷĻ ǒƭĻ ǞźƷŷźƓ ƷŷĻ /źƷǤƭ <br />Industrial District; and <br />4.The city has standards for parking, landscaping, lighting, building materials, and other elements <br />in the zoning code which are reasonably appropriate to encourage high quality development in <br />the City; and <br />18 <br /> <br />
