City of Centerville <br />Council Meeting Minutes <br />September 27, 2006 <br />City Administrator Larson indicated that the insurance should run concurrent with the <br />license year to eliminate the need to deal with this every few months. <br /> <br />Council would like to discuss this with the business owner at license renewal time. <br /> <br />Motion by Council Member Paar, seconded by Council Member Lee, to approve <br />renewal of the 2:00 a.m. closing for Mountain Enterprises, Inc., dba Trio Inn. All in <br />favor. Motion carried unanimously. <br /> <br />Mayor Capra asked Staff to look at the ordinance to see if it can be amended to assist <br />Staff with enforcement of these types of issues and notify Centennial Police of the <br />insurance issue. <br /> <br />2. Resolution #06-045 – Expressing Support & Congratulations to the Town of <br />Columbus <br /> <br /> Mayor Capra noted that Columbus Township has incorporated to become a City. <br /> <br />Motion by Council Member Terway, seconded by Council Member Paar, to <br />approve Resolution #06-045 – Expressing Support & Congratulations to the Town <br />of Columbus. All in favor. Motion carried unanimously. <br /> <br /> 3. Center Street <br /> <br />City Administrator Larson indicated that the City is in the process of building a trail <br />through Outlot E of Pheasant Marsh Third Addition and the trail stops short of Center <br />Street. Staff has found that there is an outlot that the State of Minnesota owns due to tax <br />forfeit and there is an easement across it, however the easement doesn’t provided for a <br />trail. He then suggested that the City should acquire the property to allow for the trail to <br />cross it and connect with Center Street. He further indicated that there is an adjoining <br />property owner that has extended a fence over to a portion of it and he could claim that he <br />owns the property now by adverse possession. <br /> <br />Council Member Lee indicated he would like to have City Attorney Glaser look into <br />having the fence removed to allow room for the trail. <br /> <br />City Administrator Larson suggested pursuing a restricted deed and then work out getting <br />the unrestricted deed and work out the specifics with the adjoining property owner. <br /> <br />Motion by Council Member Lakso, seconded by Council Member Terway, to <br />approve acquiring the parcel. All in favor. Motion carried unanimously. <br /> <br />Council Member Terway asked for legal interpretation of the unrestricted and restricted <br />deed and ability to look into the adverse possession situation. <br /> <br /> 4.
