<br />Motion by Council Member Broussard Vickers. seconded by Council Member to <br />adopt Resolution #01-020 awarding the sale of $990.000 General Obligation <br />Improvement Bond based on the attorney's recommendation and the appropriate <br />numbers being placed in the document as presented by United Bankers Bank. All in <br />favor. Motion carried unanimously. <br /> <br />Mr. Eilertson requested that the Mayor and City Administrator accept the bid presented <br />by United Bankers Bank. Same signed the appropriate documentation. <br /> <br />2. Mr. and Mrs. Ken Carpenter, 6985 - 20th Avenue North - Zoning of Residence <br /> <br />Mr. Carpenter stated that he owns two (2) parcels, one in which his home is built on and <br />another that abuts same where his business is operated. Mr. Carpenter stated that both of <br />his parcels are zoned Commercial. Mr. Carpenter stated that when he built his home it <br />was allowable to construct a residence in a Commercial District; however, it was not <br />allowable to build a commercial business in a Residential District. Mr. Carpenter desired <br />to refinance his home and was informed by staff that his residence was none conforming <br />and if destroyed more than 50% he could not rebuild. Mr. Carpenter felt that the City <br />changed the rules midstream without notifying him of same. <br /> <br />City Administrator Moore-Sykes stated that the lender had been notified that the property <br />was zoned commercial and had contacted the City for additional information. <br /> <br />Mr. Hoeft stated that it appears that the property has always been zoned Commercial and <br />should not have been constructed. Mr. Hoeft stated that the residence is considered a pre- <br />existing condition and non-conforming. Mr. Hoeft stated that the City has not done <br />anything improper in this matter. <br /> <br />Mayor Swedberg questioned Mr. Hoeft as to the ability of Mr. Carpenter to sell this <br />residence. Mr. Hoeft stated that Mr. Carpenter could sell the home as Commercial <br />property. <br /> <br />Mayor Swedberg indicated that Mr. Carpenter had a very deep lot and asked if the <br />commercial zoning covered the entire lot or just the front portion of that lot. <br /> <br />Council Member Broussard Vickers indicated that the entire parcel would be zoned <br />commercial as it is listed under one (1) PIN number. <br /> <br />Mr. Carpenter stated that he had followed City Code and questioned how he could now <br />be penalized. <br /> <br />Ms. Moore-Sykes indicated that nothing had changed with the City Code and suggested <br />that perhaps the lender changed the way it looks at things as compared to years ago when <br />the structure was built. <br /> <br />Page 3 of 23 <br />
