Planning and Zoning Commission <br />Meeting Minutes <br />November 14, 2006 <br /> <br />Mr. Keleher stated that they can bring a sample board to the Council meeting. <br /> <br />Mr. Thomas distributed a picture of the Eagle Brook Church that showed a more accurate <br />portrayal of the two colors planned for this building. <br /> <br />Mr. Larson reviewed the conditions recommended by the Commission. <br /> <br />Motion by Commissioner Klennert Hunt, seconded by Commissioner Wright, to <br />recommend approval for the Sedona Homes Conditional Use Permit, subject to a <br />noise study being completed on the HVAC system, that the colors will complement <br />the development, that a review by the City engineering staff will be complete, that <br />the building will be constructed with architectural grade sandstone finished panels, <br />that the HVAC unit will be screened to the west neighbors, that the <br />garbage/dumpster area will be enclosed with similar building materials and subject <br />to lighting study on downcast lighting. All present in favor, motion carried <br />unanimously. <br /> <br />Chair Hanson stated that he would like the Fire Department to take a look at the plans <br />also. <br /> <br />Motion by Commissioner Klennert Hunt, seconded by Commissioner Love, to <br />recommend approval for Sedona Homes Preliminary Plat. All present in favor, <br />motion carried unanimously. <br /> <br />V. NEW BUSINESS <br /> <br /> 1. Request for Lot Split – Mr. Erick Marshall, 1688 Sorel Street <br /> <br />Mr. Larson noted a letter that the City Attorney had submitted regarding this request and <br />his opinion that this lot split should not be approved. <br /> <br />Mr. Marshall stated that he bought the property in June of 2005 and had it surveyed at the <br />time with the intention of splitting the lot. Mr. Marshall reviewed his history in working <br />with the City to split the property. He stated that the City has changed the zoning rules <br />twice since he purchased the property and he feels this has adversely affected the <br />marketability of his property. He stated that John Meyer has offered to purchase the <br />property, but not at the lot split value. He stated that he would be willing to sell if it is <br />purchased at its appraised value. He stated that if the City will not purchase the land, he <br />would like the lot split to be allowed under the original zoning rules when he purchased <br />the property. <br /> <br />Mr. Larson stated that John Meyer was trying to establish a price for the property to <br />possibly pursue grant money. He stated that there has been no action by the City Council <br />authorizing the purchase of this property. He stated that the City is working with a <br />developer for the downtown area and are hopeful that the developer will have a plan that <br />Page 6 of 8 <br />
