<br />3. Plan Approval. The City hereby approves the following preliminary <br /> <br />and/or final plans ("Plans") which 'are on file with the City. The Plans shall not be <br /> <br />attached to this Agreement. The Developer shall develop the Property in accordance with <br /> <br />the Plans or amendments thereto acceptable to the City Engineer and City Administrator. <br /> <br />If, however, the Plans vary from the written terms of this Agreement, the written terms <br /> <br />shall control.
