<br />S. Surv~y. Seller shall provide to Buyer at Seller's expense a current "as- <br />buih" swvey of the Property, showing access, easements, buildings, improvements, <br />parking areas, encroachments, utility lines and all other information generally included in <br />a swvey of commercial real property, together with the legal description of the Property, <br />currently certified to Buyer and to the title insurance company referred to in Paragraph 6 <br />hereof. Buyer reserves the right to make written objections to marketable title based <br />upon said swvey within IS days after it receives the title commitment descn"bed in <br />Paragraph 6 below. Any such objections to title shall have the same effect as objections <br />to title raised by Buyer under Paragraph 6 hereof. <br />6. Title Examination. Within a reasonable time after acceptance of this <br />Agreement, Seller shall furnish Buyer with an Abstract of Title or a Registered Property <br />Abstract certified to date including proper searches covering bankruptcies and State and <br />Federal judgments, liens, and levied and pending special assessments. Buyer shall have <br />1 S business days after receipt of the abstract of title or registered property abstract, at <br />Buyer's own expense, to make an application for a title insurance policy and notify Seller <br />of the application. Buyer shall have IS business days after receipt of the commitment for <br />title insurance to provide Seller with a copy of the commitment and written objections. <br />Buyer shall be deemed to have waived any title objections not made within the applicable <br />lS-day period set forth above, except that this shall not operate as a waiver of Seller's <br />covenant to deliver a warranty deed. If any objections to title are not made and Seller <br />notified, all as herein provided, within the aforementioned lS-day period, such objections <br />shall be deemed waived, but such waiver shall not negate the obligation of Sener to <br />convey the Property by warranty deed and warranty bill of sale, subject to the objections <br /> <br />4 <br /> <br />/9 <br />
