Green Consulting Engineers <br />Greg Hellings, City Attorney <br />************************~***************************************************** <br /> <br />CALL TO ORDER <br />Mayor Wilharber called the Council meeting to order at 6:00 p.m. <br /> <br />PUBLIC HEARING <br /> <br />APPEARANCES <br /> <br />NSP Gas Franchise <br />l\1r. Hellings gave an overview of Northern States Power Company's (NSP) request for a gas <br />franchise. Furthermore, in order for a public utility to utilize a public right-of-way, there must be <br />a franchise agreement between Centerville and NSP. Currently, the City has a franchise <br />agreement with Minnegasco. l\1r. Hellings stated NSP' s agreement is typical of a public utility <br />contract. However, utility companies usually allocate 3 to 7 percent for franchise fees to Cities. <br /> <br />l\1r. March commented NSP has requested to provide gas service from east of35W to the <br />undeveloped industrial area in Centerville. l\1r. March added some concerns he had with the <br />contract; if the governing body adopts an ordinance in the future, NSP is exempt. l\1r. March <br />noted developers have requested NSP and there is no interest in competing with Minnegasco. <br />However, l\1r. March recommended denying the franchise agreement. <br /> <br />l\1r. Hellings stated if gas line relocation is required within five years the City is responsible for <br />paying the cost. <br />
