Mr. March reported Mr. Navin (Park and Recreation Chairman) did not foresee the Park and
Recreation taking property in lieu of cash. However, Mr. Porter (park and Recreation Member)
suggested the city take the park funds.

Councilmember Helmbrecht questioned the Developer as to the purchase price of the property.
Mr. Buechler responded the purchase price has not been settled. Mr. Buechler confirmed a four
unit subdivision would not require a 10 percent park dedication fee. Mr. Jay McNab (Mr.
Buechler's legal council) defined the ordinance pertaining to 10 percent of land value as "the land
value" prior to subdivision or in its current status.

Councilmember Brenner requested Park and Recreation's recommendations prior to Council
action.

Mr. Lloyd Drillings (7185 Mound Trail) implied the park dedication fee ordinance was designed
with the idea to obsorb the population impact on the community, namely the parks. Whereas, this
small development will not have a significant impact on the community. Mr. Hal Liebel (7397
Main Street) shared because of the condemnation process Anoka County took hundreds of acres
for park purposes. Mr. Drillings commented that five lots will have less impact on the community
then a 42-10t development.

Mr. Jim Hoeft (Legal Council) noted the value of a property is based on recent sales and the
purchase price. For example, the amount of dollors paid for the vacant land is the worth of the
land. The Council discussed the City's history regarding park dedication fees. Councilmember
Brenner and Helmbrecht favored tabling the issue until the Parks and Recreation Committee has
an opportunity to make recommendation. Councilmember Buckbee favored negotiating the park
fees between the Developer and the City. Mayor Wilharber favored negotiating a fee, but felt the
$900 per lot fee, is too inexpensive.

Councilmember Buckbee moved to direct City Staff to investigate Parkview. Acorn Creek and
Clearwater Meadows land value/ park dedication fees and the ratio in comparison to the 10
percent ofland vs. park dedication fees within the last two year. Councilmember Helmbrecht
seconded the motion. Motion carried unanimously.

Councilmember Brenner moved to refer this matter to the Park and Recreation Committee for its
consideration. Councilmember Helmbrecht seconded the motion. Motion carried unanimously.

The Council elected to discuss the Buechler Estates roads if the Developer's plans are to proceed
with the development.

Block Party - Brian Drive
Councilmember Buckbee moved to approve the block party contingent upon the
surrounding residents signing a waiver indicating the party meets with their approval and
that the Police and Fire are notified ofthe date and time ofthe party.
