<br />~"J ___u_u ~'-------CJ -------- -- - <br /> <br />t <br /> <br />Brenner expressed some concern for the decrease in the amount of open space in <br />comparison to the sketch plan. Mr. Olson explained that the single family lots go all the <br />way back to the creek now and originally it was park property. Although it is still open <br />space it is not included in the total percentage. <br /> <br />March reported that PUDs do not need to be rezoned but the notice was published as a <br />rezone also so that the council can if they see fit. <br /> <br />They discussed doing the project in phases because of the time constraints. They also <br />discussed the trailway system. <br /> <br />Tony Emrich stated they would outlot the areas by the adjoining property until the issues <br />with the property owner are settled. <br /> <br />Brenner is concerned about approving the project without FEMA and without reviewing <br />the minutes from the P&Z public hearing. <br /> <br />Brenner would like to have a feasibility study done. She feels it should be documented. <br /> <br />MOTION by Wilharber, second by Buckbee to approve the preliminary plat with the <br />contingency that all the items in MSA's letter dated July 8, 1996 be addressed and the <br />position of the private streets in the southwest corner be eliminated and turned into outlots <br />and homes be realigned prior to approval of final plat if the property has not been sold to <br />developer at that time. If the developer does have a deal with property owner a sketch <br />plan needs to be submitted. Motion carried, Brenner voted nay. <br /> <br />Brenner commented that she is not opposed to the development but believes the best <br />interest of the city would be to have a feasibility study done. <br /> <br />MOTION by Wilharber, second by Buckbee to authorize MSA to prepare plans and <br />specifications for the Eagle Pass development contingent upon receipt of the appropriate <br />escrow. Motion carried, Brenner voted nay. <br /> <br />Clearwater Meadows <br /> <br />Nyberg stated that RCWD has given approval to the project but that all the contingencies <br />have not been met yet. Including: signed deed restrictions, trail easements, outlots <br />signed, and FEMA. <br /> <br />School Water Project <br /> <br />Nyberg provided the council with a project update, stating the project should be complete <br />in a couple of weeks -- depending on the weather. <br /> <br />Hensel Property <br />CC7-10MM.WPS <br /> <br />4 <br />
