<br />ORDINANCE NO.8 <br /> <br />AN ORDINANCE REGULATING THE SUBDIVISION AND PLATTING OF LAND <br />WITHIN THE CI TY OF CENTERVILLE, MINNESO TA AND PROVIDING FOR <br />THE ADMINISTRATION AND ENFORCEMENT OF SUCH REGULATIONS. <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA ORDAINS: <br /> <br />ARTICLE 1. GEN~RAL PROVISIONS <br /> <br />11 . TI TLE . Thi s ordinance may be ci te d as the "C en terville <br />Subdivision Ordinance" and will be referred to herein as <br />"this ordinance". <br /> <br />12. JURISDICTION. The geographic jurisdiction of this <br />ordinance includes the entire area within the corporate limits <br />of Centerville, Minnesota. <br /> <br />13. DEFINED WORDS. Words used in a special sense in this <br />ordinance are defined in ARTICLE 6. <br /> <br />14. PURPOSE. This ordinance is adopted: <br /> <br />14.01. To assist the orderly, efficient and integrated <br />development of the City; <br />14.02. To provide uniform procedures and standards for <br />all subdivisions; <br />14.03. To ensure consistency between future subdivision <br />development and the Centerville Comprehensive Plan; <br />14.04. To provide for the protection and conservation of <br />flood plains, shorelands, soils, water, vegetation, <br />energy, air quality, geologic and ecologic <br />features and agricultural lands. <br /> <br />15. COMPLIANCE. Platting is required for all subdivisions <br />creating five (5) or more lots or parcels which are two and <br />one-half (2t) acres or less in size. Hereafter, no lot in a <br />subdivision may be sold, no permit to erect, alter or repair <br />any building upon land in a subdivision may be issued, and <br />no building may be erected in a subdivision, unless and until <br />a subdivision plan has been approved and, where required, <br />recorded, and until the improvements required by the Council <br />in connection therewith have either been constructed or <br />guaranteed, as herein provided. <br /> <br />16. CONFLICT. Where the conditions imposed by any provisions <br />of this ordinance are either more or less restrictive than <br />comparable conditions imposed by any other regulation, the <br />regulations which impose the higher standard or requirements <br />shall prevail. <br /> <br />17. SEVERABILITY. If any provlslon of this ordinance or the <br />application of any provision to particular circumstances is <br />held invalid, the remainder of the ordinance or the application <br />of such provision to other circumstances shall not be affected. <br />
