Meeting Minutes CC
October 25, 1989
Page Three
incorporate all persons as per the City Attorney's suggestion.
He also suggested that the proposed ordinance could be amended
with regard to Section 2, Individual Use, #1, referencing a hand
made device. He noted that this could be further clarified to
define a hand made device as being able to discharge a
projectile.
Council member Pelton expressed concern regarding the distance
from which a gun may be fired within the City from a residence.
She expressed concern for many children playing outside, and
noted that at times they are difficult to see.
Council member Burgstahler noted that with regard to outdoor
ranges it was his opinion that an air rifle or bow and arrow
range could be possible, but that Centerville was too small for
any other type of shooting range.
Mayor Haberman expressed concern amending Subdivision 2, Section
2 of the ordinance to extend the shooting distance from 200 to
500 feet as 500 hundred feet does go beyond the DNR regulations.
He is concerned about possible penalties and liabilities in doing
so. Mayor Haberman also expressed concern with regard to the
City Attorney opinion which at times states "I believe" versus
"the law states". He advised that per this conversation at the
City Council meeting and per the City Attorney comments he would
work on a rewrite of the Fire Arms ordinance #5.
Motion by Burgstahler, second by Neumann to accept Mayor
Haberman's offer to rewrite the proposed Fire Arms Ordinance #5
to incorporate the City Attorney's opinion, motion carried
unanimously.
The proposed Fire Arms Ordinance #5 and the City Attorney's
opinion regarding said Fire Arms Ordinance dated September 29,
1989 is on file with the Clerk/Administrator.
Motion by Burgstahler, second by Pelton to approve attendance of
the "Secrets of Successful Supervision" workshop on Thursday
November 9, 1989 in Plymouth, MN for the Clerk/Administrator and
the Public Works Director, motion carried unanimously.
Motion by Burgstahler, second by Pelton to approve attendance to
the "Alexandria Computer Symposium" on November 2, 1989 and/or
November 3, 1989 for Council member Peterson should he choose to
attend, motion carried unanimously.
