A copy of
this letter is on file with the Clerk/Administrator. The letter
advises that the City Attorney has reviewed the low bid of
Northdale Construction for the proposed water project and he has
found the bid to be valid. The letter is in reference to
correspondence from Bill HaWkins, City Attorney, dated August 3,
1990 which advises that Northdale Construction's failure to
acknowledge receipt of an addendum on the water bid did not have
any substantial impact on the amount of the bid, and that as long
as the bid did include the items that were requested in the
specifications the omission was not material and the City could
accept them as the low bidder.

Motion by Burgstahler, second by Neumann to request Barry
Blomquist, City Attorney, to review the bid of Northdale
Construction with regard to their failure to indicate on the bid
that they had acknowledged receipt of an addendum; the second
opinion is being requested in light of a threatened lawsuit by
Ro-So Contracting, Inc. who submitted the second lowest bid; motion
carried unanimously.
