City Council October 25, 1995 Meeting Minutes MOTION by Wilharber, second by Helmbrecht that the trail easement for Acorn Creek One be deleted and future thought be given to when the Moore property is developed that a trail easement be brought in through the east and to accept Mr. Rehbein's offer of a sidewalk on Revoir in trade for the trail easement. And also to return the escrow of $5,000.00. Motion carried unanimously. CENTER OAKS DRAINAGE Dave Nyberg requested that a survey be done for that area so that answers can be given to the residents at the November 14, 1995 meeting. The survey will point out exactly what will need to be taken out. Consensus was to get the concerns from the residents prior to getting a survey done due to the cost. NORTHERN FOREST PRODUCTS Steve Bubul, Kennedy & Graven, was present and explained to the council what needed approval and signed in order to complete the purchase agreement with Northern Forest Products. MOTION by Buckbee, second by Brenner to approve Resolution 95-20 - a resolution awarding the sale of, and providing the form, terms, covenants and directions for the issuance of its $32,250 tax increment revenue not, series 1995A. Motion carried unanimously. MOTION by Buckbee, second by Brenner to approve Resolution 95-21 - a resolution awarding the sale of, and providing the form, terms, covenants and directions for the issuance of its $114,051.19 tax increment revenue note, series 1995B. Motion carried unanimously. MOTION by Buckbee, second by Brenner to approve the assignment of the contract. Motion carried unanimously. Steve Bubul addressed the issue of a second phase to be done in 1999 added to the contract. Paul McDowell will bring it before the council at a future meeting.
