<br />325 COUNCIL MEETING MINUTES <br />326 NOVEMBER 9, 1994 <br />327 PAGE SEVEN <br />328 <br />329 Public Works Director/Building Inspector, regarding construction <br />330 of the stairway to 7096 Progress Road. It was noted Ordinance <br />331 #4, Subdivision 34.02-3 states a landing place or uncovered porch <br />332 may extend into the required front yard to a distance not <br />333 exceeding six (6) feet. The landing place at 7096 Progress Road <br />334 extends ten (10) feet in the front yard. A copy of the <br />335 information is on file with the Clerk/Administrator. <br />336 <br />337 Motion by Wilharber, second by Dario that the intent of the <br />338 variances granted on June 11, 1986 and September 9, 1994 was to <br />339 include the sidewalk and landing place as illustrated in the <br />340 sketch prepared by Paul Palzer, Public Works Director/Building <br />341 Inspector, motion carried unanimously. <br />342 <br />343 NEW BUSINESS: <br />344 <br />345 Request for Variance - 1573 Peltier Lake Drive. <br />346 Council member Dario removed himself from the City Council. <br />347 <br />348 The City Council reviewed the Request for Variance Report <br />349 information prepared by City staff dated November 1, 1994 <br />350 regarding Thomas and Kristine Dario's, 1573 Peltier Lake Drive, <br />351 request for variance. A copy of this information is attached to <br />352 made a part of this minutes. <br />353 <br />354 The Planning and Zoning Commission conducted a public hearing on <br />355 November 2, 1994. It was noted that there was no one present who <br />356 opposed the granting of the variance. <br />357 <br />358 Motion by Buckbee, second by Wilharber to approve the Request for <br />359 Variance from Ordinance #4, Section 34.01-3 of Thomas and <br />360 Kristine Dario, 1573 Peltier Lake Drive, to construct additional <br />361 living space and deck to a single family home approximately <br />362 thirty-seven (37) feet from the lake (nine foot rear yard <br />363 variance) based upon the recommendation of the Planning and <br />364 Zoning Commission as follows: <br />365 special conditions and circumstances exist which are <br />366 peculiar to the land involved and do not result from <br />367 the actions of the petitioners. The property is <br />368 lakeshore; <br />369 literal interpretation of the provisions of this <br />370 ordinance would deprive the petitioner of rights <br />371 commonly enjoyed by other properties in the same <br />372 district under the terms of this ordinance. The <br />373 neighboring properties enjoy the same setback; <br />374 granting the variance requested will not confer on the <br />375 applicant any special privilege that is denied by this <br />376 ordinance to other lands, structures or building in the <br />377 same district; <br />378 <br />
