Mr. Stewart noted the <br />City has be certain it has the authority and responsibility to <br />maintain all drainage areas within the City. Mr. Stewart noted <br />the Committee would like the City Attorney's opinion regarding <br />which drainage areas are the City's responsibility. Mr. Stewart <br />noted that just because you plot an easement does not necessarily <br />mean it is a City's responsibility. <br /> <br />Mayor Buckbee noted the Committee is involving the city Engineer <br />and the City Attorney as to not open the City up to fixing every <br />properties drainage problem. Mayor Buckbee expressed the <br />Committee can not continue on until they have a legal opinion. <br /> <br />Mr. Stewart noted that Centerville's Storm Water Management Plan <br />requires regional detention ponds. The regional detention ponds <br />are to be located in the Acorn Creek Development and near the L & <br />G Rehbein Company on 20th Avenue South location. Mr. Stewart <br />noted that current storm water user fees will not come close to <br />paying for the City's portion of the regional detention ponds. <br />Mr. Stewart noted that in the Acorn Creek Development the <br />developers and the City's costs are approximately $650.00 to <br />$800.00 per lot respectively. Mr. Stewart suggested the fee per <br />lot be increased. <br /> <br />Ken Carpenter, 6885 20th Avenue South, was present. Mr. <br />Carpenter asked if the ponds are designed to be wet or dry. <br /> <br />Mr. Stewart noted that ponds developed after 1991 are to be wet. <br />Mr. Stewart noted the Acorn Creek Development pond is an eight <br />acre pond with a 3 to 5 1/2 foot depth. <br /> <br />Motion by Buckbee, second by Dario to direct City staff, City <br />Engineer and City Attorney to prepare calculations for storm <br />water drainage fees per lot for future developments; <br />until the calculations are approved by the City <br />Council, City staff shall alert potential developers of <br />.a possibly increase in storm water drainage fees per <br />lot; <br />the proposed increase in the storm water drainage fee <br />could be between $500.00 to $1,000.00 per lot; <br />the cost for consulating engineer and attorney fees <br />shall not exceed $1,200.00, <br />motion carried unanimously. <br /> <br />direct City staff to <br />what is pUblic and <br />cost to prepare the <br />per lot for future <br /> <br />Motion by Buckbee, second by Helmbrecht to <br />work with the City Attorney to determine <br />private drainage areas before incurring <br />calculation for storm water drainage fee <br />developments; <br />and to develop what the costs would be to maintain both <br />
