Mr. Neumann <br />asked if the storm sewers in the Royal Meadows development have <br />ever been checked for capacity. <br /> <br />Mr. Stewart noted he has not been asked nor has he initiated the <br />task of checking the capacity of the storm sewers within the <br />Royal Meadows Development, however there should not be a problem <br />with the catch basins. <br /> <br />Kevin McGown, 1988 Cardinal Drive, asked what the guidelines are <br />for determining priorities. <br /> <br />Mayor Buckbee noted that Mr. <br />concerns in writing, and to his <br />completed. <br /> <br />McGown was requested to put his <br />knowledge this request was not <br /> <br />PETITIONS AND COMPLAINTS <br /> <br />Acorn Creek - Development 7389 Mill Road <br />The City Council reviewed a letter dated October 25, 1993 from <br />James Carson, 7389 Mill Road, regarding the recent work on the <br />Acorn Creek Development. <br /> <br />A copy of this letter is attached to and made a part of these <br />minutes. <br /> <br />John Stewart, City Engineer, was present. Mr. Stewart noted the <br />Development Agreement between R & R Leasing, Inc. and the City of <br />Centerville stipulates the haul road for construction is to be <br />73rd Street. Mr. Stewart noted the MSA, Consulting Engineering <br />Inc., Inspector left early on one occasion and the <br />contractor/subcontractors started hauling on Mill Road. Mr. <br />Stewart expressed this was inappropriate for the <br />constractor/subcontractors to use Mill Road as they did. Mr. <br />Stewart suggested the damage be investigated and if a <br />preponderance of the evidence suggests that the contractor did <br />cause damage to the roads they could be held liable for repairs. <br /> <br />Mayor Buckbee noted that it appeared vehicles were cited by the <br />Circle Pines/Lexington Police Department for being overweight on <br />Mill Road. <br /> <br />Tamara Miltz-Miller, Clerk/Administrator, noted the contractor <br />had been warned to stay off the roads not stipulated in the <br />Developer's Agreement. Ms. Miltz-Miller expressed that it was <br />her understanding this violation will be cited under Minnesota <br />State Statutes versus City Ordinance. <br />
