Article 3. Section 34.01 GENERAL REQUIREMENTS- <br />amendment. <br />The proposed amendment to Ordinance #4, Article 3, Section 34.01 <br />GENERAL REQUIREMENTS would allow averaging the front yard <br />setbacks of adjacent property to determine a minimum setback (not <br />less than twenty five (25) feet. <br /> <br />Clerk/Administrator Tamara Miltz-Miller noted the <br />has expressed concern regarding the possibility of <br />widened in the future. An area such as Peltier <br />already constricted with nonconforming setbacks. <br /> <br />City Engineer <br />streets being <br />Lake Drive is <br /> <br />Mayor Buckbee, in his written comments dated October 13, 1993, <br />noted that he does not have any problems with a proposed <br />averaging of two adjacent properties but no closer than 25 feet, <br />however he suggested excluding new construction. <br /> <br />A copy of Mayor Buckbee's comments are attached to and made a <br />part of these minutes. <br /> <br />Clerk/Administrator Tamara Miltz-Miller noted that areas such as <br />the Acorn Creek Development could be effected by the Sievert and <br />Kelly properties. Ms. Miltz-Miller explained that corner lots <br />are considered to have two front yards with a thirty five foot <br />setback on each side. The Sievert and Kelly properties are non- <br />conforming. <br /> <br />Acting Mayor Wilharber suggested having the Planning and Zoning <br />Commission review the proposed amendment to exclude new <br />construction. <br /> <br />Jeff Godwin, 1581 Peltier Lake Drive, was present and offered <br />comment regarding the proposed amendment. <br /> <br />Motion by Brenner, second by Helmbrecht to approve the <br />recommendation of the Planning and Zoning Commission to amend <br />Ordinance #4, Article 3, Section 34.01 GENERAL REQUIREMENTS as <br />follows: <br />NOW READS: <br />34.01 GENERAL REQUIREMENTS.
