~

Special Meeting Minutes - CC
Acorn Creek
October 4, 1993
page three

Council member Wilharber appeared to be of the op~n~on that the
preliminary plat first be reviewed by the Planning and Zoning
Commission and the Park and Recreation Committee, to assure that
they are in agreement that the park should be extended to the
north.

Council member Helmbrecht express concern about the lateness in
the year. If the amendment were not approved, the Contractor
would have to grade and seed the park land as approved on the May
27. 1993 grading plan. Then if the grading plan were amended at
a later date, the Developer would be responsible for regrading
and reseeding the park.

Motion by Wilharber, second by Brenner to consider Mr. Rehbein's
request for a grading plan amendment at the October 13, 1993
City Council meeting, after comment by the Planning and
Zoning Commission (October 5, 1993 meeting) and Park and
Recreation Committee (October 6, 1993 meeting),
aye: Dario, Brenner, Wilharber; nay: Helmbrecht.

Mr. Rehbein appeared to express concern that he felt such grading
plan amendment decisions should be left to the discretion of the
City Engineer in the field.

Mr. Stewart appeared to be of the op~n~on that the City Council
should make the decisions with regard to grading plan amendments.
However, if it were the direction of the City Council he could
make such discretionary field decisions.

It appeared to be the consensus of the City Council that grading
plan amendments and other significant project adjustments/changes
be brought before the City Council for direction.

Motion by Wilharber, second
motion carried unanimously.

by Dario to adjourn the meeting,
Meeting adjourned at 8:01 p.m.

Respectfully submitted,

Tamara M.
