CITY COUNCIL MEETING MINUTES
NOVEMBER 22, 1993
PAGE SIX

Ordinance 151 and these reV1Slons will be discussed at
a meeting of the City Council after January 1, 1994,
motion carried unanimously.

A copy of this resolution is attached to and made a part of these
minutes.

Motion by Buckbee, second by Brenner to request the City Attorney
review Ordinance 151 for compliance with Minnesota State
Statutes, motion carried unanimously.

OLD BUSINESS:

1862 Main Street - Second Driveway.
The City Council reviewed the following information:
December 21, 1992 City Council meeting minutes;
Site plan of municipal building site;
Letter dated January 15, 1993 from Randy Bettinger,
Traffic Engineer Technician, Anoka County to Connie
Wyne, 1862 Main Street;
Letter dated January 22, 1993 from the City of
Centerville to Jon Olson, Anoka County Director of
Highways;
Notes dated November 9, 1993 regarding a conversation
with Jon Olson, Anoka County Director of Highways.

A copy of this information is attached to and made a part of
these minutes.

Steven and Connie Wyne, 1862 Main Street, were present. Ms. Wyne
expressed it was her opinion that the driveway encroaches upon
City property by 1 to 1 1/2 feet. Ms. Wyne noted when the rock
is replaced by the City, they would move the driveway as close to
the trees as possible. Ms. Wyne stated they would sign a waiver,
that if they do drive over City property, they would not hold the
City liable.

It appeared to be the consensus of the City Council that City
staff should write a letter to Anoka County stating the Wyne's at
1862 Main Street, have agreed to no longer utilize City property
as a second access to Main Street;
that because the property owner is no long using City
property, the City of Centervil1e does not have the
authority to require the property owner to have only
one access onto a County road;
the property owner is now using the second access, but
only drives on his private property and County street
right-of-way;
the City does not condone the second access, but the
issue now appears to be between the property owner and
