<br />Council Meeting Minutes <br />August 26, 1987 <br />Page Four <br /> <br />Associates, noted that this is not uncommon as part of a <br />development agreement, and that the bond monies are released as <br />the properties are assessed. City Engineer advised that <br />sometimes the bond is lowered or released as underground pipes <br />are put in. Clerk advised that this may not coincide with what <br />the City Attorney intended. City Engineer will contact the City <br />Attorney to verify the intent of the 35% bond and clarify the <br />proposed costs of the proposed water project. <br /> <br />John Johnson representing Centerville Heights asked about City <br />policy on issuing building permits in a new development with <br />regard to street reconstruction and utility installation. City <br />advised that developments have been looked at on an individual <br />basis with regard to this in the development contract. <br /> <br />Discussion of an Addendum to the Development Contract between the <br />City of Centerville and Jerry Parent of Parent Construction <br />regarding the L'Allier Estates II development submitted by Jerry <br />Parent was discussed. A copy of this addendum is on file with <br />the City Clerk. <br /> <br />Motion by Neumann, second by Wilharber to submit the proposed <br />Addendum to City Attorney, William Hawkins for review for the <br />protection of the City's interest; that #5 regarding the total <br />assessment against each lot be rewritten giving a break down of <br />the $2,500; that #7 be rewritten to delete "and there shall be no <br />assessment levied against said lots for city water installed at a <br />later date"; the addendum is to then go to Jerry Parent's <br />attorney for review, motion carried unanimously. <br /> <br />Motion by Wilharber, second by Fritchie to have the concern of <br />35% bond against the assessed properties of the developments in <br />question be worked into the feasibility study ordered for the <br />proposed water system; to then receive recommendation from the <br />City Attorney; to reconsider the addendum at the September 22, <br />1987 Chapter 429 hearing for the proposed water project, motion <br />carried unanimously. <br /> <br />Motion by Fritchie, second by Wilharber to direct the City <br />Attorney to review #3 of the Addendum to the Development Contract <br />for L'Allier Estates II, questioning the time limit of July 1, <br />1988 for an operable system, motion carried unanimously. <br /> <br />Motion by Fritchie, second by Neumann to direct City Attorney to <br />draft a City Ordinance requiring developments within the City of <br />Centerville to install a water system, aye: L'Allier, Fritchie, <br />Wilharber, Neumann; nay: Laska, motion carried. <br /> <br />NEW BUSINESS <br />Motion by Fritchie, second by Neumann to have the development <br />
