RE S GLUT 10N WHEREAS, the City has entered into an agreement with the County of Anoka calling for the vacation of that portion of old Mound Trail described hereinafter upon completion of the construction and conveyance of an easement for the new roadway designated as Mound Trail immediately to the North; and WHEREAS,. the County has completed said construction and conveyance; and WHEREAS, the City Council has held a public hearing preceded by two weeks published and posted notice concerning the vacation of the existing Mound Trail, reserving unto itself an easement for utility and scenic purposes; NOW, THEREFORE1, BE IT RESOLVED, that that portion of the street known as Mound Trail lying west of the center line of Anoka County State Aid highway No. 14 located within Lots 7, 14, 15 and 16, Auditor's Subdivision No. 46 Revised, Anoka County, Minnesota, is hereby vacated except the City shall reserve unto itself an easement for sanitary sewer purposes including, but not limited to, the laying of pipe, installing manholes and other appurtenances for a sanitary sewer system together with the perpetual right of ingress and egress on said easement to accomplish said purposes and further reserving unto itself a scenic easement in perpetuity to control, enhance and restrict said property in accordance with the terms and conditions hereinafter prescribed. 1. No dumping, placement or storage of ashes, trash, junk, rubbish, sawdust, garbage or offal, shall hereafter be allowed upon the scenic area. The City of Centerville and its agents may clear and remove from the scenic area any of the aforementioned material and dispose of such material without any liability. 2. No trees or shrubs shall be destroyed, cut or removed from the scenic area except as may be required for selective cutting of timber as specifically authorized by ' written permit from the City Council or their designated agents.
