RE S GLUT 10N <br />WHEREAS, the City has entered into an agreement with <br />the County of Anoka calling for the vacation of that portion <br />of old Mound Trail described hereinafter upon completion of the <br />construction and conveyance of an easement for the new roadway <br />designated as Mound Trail immediately to the North; and <br />WHEREAS,. the County has completed said construction <br />and conveyance; and <br />WHEREAS, the City Council has held a public hearing <br />preceded by two weeks published and posted notice concerning <br />the vacation of the existing Mound Trail, reserving unto itself <br />an easement for utility and scenic purposes; <br />NOW, THEREFORE1, BE IT RESOLVED, that that portion <br />of the street known as Mound Trail lying west of the center <br />line of Anoka County State Aid highway No. 14 located within <br />Lots 7, 14, 15 and 16, Auditor's Subdivision No. 46 Revised, <br />Anoka County, Minnesota, is hereby vacated except the City shall <br />reserve unto itself an easement for sanitary sewer purposes <br />including, but not limited to, the laying of pipe, installing <br />manholes and other appurtenances for a sanitary sewer system <br />together with the perpetual right of ingress and egress on <br />said easement to accomplish said purposes and further reserving <br />unto itself a scenic easement in perpetuity to control, enhance <br />and restrict said property in accordance with the terms and <br />conditions hereinafter prescribed. <br />1. No dumping, placement or storage of ashes, trash, <br />junk, rubbish, sawdust, garbage or offal, shall hereafter be <br />allowed upon the scenic area. The City of Centerville and its <br />agents may clear and remove from the scenic area any of the <br />aforementioned material and dispose of such material without <br />any liability. <br />2. No trees or shrubs shall be destroyed, cut or <br />removed from the scenic area except as may be required for <br />selective cutting of timber as specifically authorized by ' <br />written permit from the City Council or their designated agents. <br />
