<br />City Council Meeting Minutes <br />Allgust 28, 1991 <br />page ttlree <br /> <br />Street, south of Shad Avenue. The second choice of the Fire <br />Department would be the current City Hall site. It was noted <br />that there were advantages and disadvantages of each site. <br /> <br />Council member Wilharber noted that after visiting the <br />Almendinger site it did not appear as low as he originally <br />thought it was. He advised that during discussions with Station <br />Chief Mohler and District Fire Chief Bennett, the Fire Department <br />would like to maintain a separate training area but had no <br />problem utilizing a fourth wall and splitting electricity or <br />other utility services with the City. <br /> <br />Motion by Pelton, second by Burgstahler to table discussion of a <br />tower/well municipal facility site; and direct City Staff to <br />prepare to an analysis of the costs of the Almendinger and <br />current City Hall sites, motion carried unanimously. <br /> <br />1987 Street Reconstruction ProDosed Re-Assessment of Non- <br />Litigants <br />The Clerk/Administrator advised that approximately 27 of the <br />petitions submitted require adjustment and that she will seek the <br />advice of the City Attorney. She noted that three signatures of <br />non-litigants were not submitted. <br /> <br />Council member Pelton noted that Art Mohlers~ and Jeff Daas~ <br />efforts in this process were phenomenal. They did an excellent <br />job. However, she noted that she was still not convinced <br />philosophically that the a re-assessment is appropriate and would <br />have to vote against such are-assessment. <br /> <br />Motion by Burgstahler, second by Dario to authorize the City <br />Staff prepare a re-assessment roll to represent are-assessment <br />for reduction of 85% of the original assessments of the 1987 <br />Street Reconstruction Project for non-litigants; <br />That an assessment hearing shall be held September <br />25, 1991, 7:00 p.m. at City Hall; <br />The City Attorney shall be consulted to inquire as <br />to whether after the adoption of the assessment, <br />if one of the three non-litigants not signing the <br />petition were to appeal the re-assessment, could <br />the City Council cancel the re-assessment <br />process; <br />Also to authorize the City Attorney to review the <br />petitions for re-assessment for completeness with <br />regard to legalities of the petitions; <br />Aye - Buckbee; Aye - Burgstahler; Aye - Dario; Aye - Wilharber; <br />Nay Pelton) motion carried. <br />
