<br />City Council Meeting Minutes <br />August 14, 1991 <br />page four <br /> <br />Council member Dario suggested checking the validity of the <br />petition. The City would hate not to give the 15% reduction when <br />they are so close. <br /> <br />Council member Pelton noted that she continues to be opposed to <br />re-assessment. <br /> <br />Motion by Buckbee, second by Dario that the City needs to put an <br />end to the issue; <br />they shall give Council member Wilharber a chance to <br />get acquainted; <br />the Staff is to verify the petitions for validity, <br />appropriateness; <br />and further discussion shall be tabled until the August <br />28, 1991 City Council meeting, <br />.-Aye - Buckbeej Aye - Dario, Aye - Wilharber; Nay - Pelton, motion <br />carried. <br /> <br />PETITIONS AND COMPLAINTS <br /> <br />Drainage Swale on the North Border of Center Oaks I - Beverly <br />Hughes, 1793 Center Street <br />Beverly Hughes, 1793 Center Street, expressed concern regarding a <br />drainage easement area on the north side of her property. The <br />easement area extends west along the north boundary of Center <br />Oaks I. Ms. Hughes appeared to suggest that the easement area be <br />constructed or corrected in such a manner that less water would <br />be standing on her property. <br /> <br />John Stewart, City Engineer, was present to address Ms. Hughes' <br />concern. Mr. Stewart noted that he has not changed his opinion <br />from June 26, 1991 City Council meeting at which this issue was <br />addressed. He advised that there is not sufficient grade between <br />Centerville Road and Ms. Hughes' property. He advised that there <br />is a flat grade on the Center Oaks I ditch/swale. He noted that <br />the swale depends upon hydrologic gradient to move the water out. <br /> <br />Ms. Hughes was advised that a petition of 35% of the property <br />owners involved in such a project could initiate such ditch <br />improvement. It was also noted that City Council action could <br />also initiate the improvement. <br /> <br />The Clerk/Administrator noted that the situation has been <br />discussed with the Public Works Director. It was the <br />Clerk/Administrator's understanding that the Public Works <br />Director advised that if the easement area on the north border on <br />the Center Oaks I Development were improved that the City would <br />still need to clean out the ditch area west of Centerville Road <br />
