City Council Meeting Minutes
August 14, 1991
page five

in order for the water to drain properly. The
Clerk/Administrator advised that this is the direction that the
City is investigating at this time. It was noted that the titles
and responsibilities of the ditch areas west of the Centerville
Road are being looked at this time.

Ms. Hughes suggested that elevations need to be shot along the
easement area and the area corrected so that the easement area on
her lot is not the lowest.

Ms. Hughes suggested that the City Council wait to extend the
Almendinger swale. Ms. Hughes suggested that the Henderson
property should be filled versus extending the Almendinger swale
and suggests that this filling not be the responsibility of the
City.

Audience members who asked questions regarding the subject were:
Theresa Davis - 7156 Brian Drive

John Stewart, City Engineer, noted that drainage easement areas
are not necessarily intended to be dry areas. He noted that the
City can not guarantee dry drainage areas. He suggested that the
City Council could work toward an education process versus
spending money in a situation where the grade just is not there.

Council member Pelton suggested that something be placed in the
next City Newsletter to initiate this education process.

Ms. Hughes inquired as to why the swamp area two houses east of
her need to be drained.

The City Council responded that the City Council has advised that
it is the City's responsibility to act in that situation.

Data Practices Compliance
Ms. Hughes read a written statement to the City Council in which
she stated that the City Council has the wrong idea regarding
Data Practices. Ms. Hughes stated that she felt the
Clerk/Administrator was vilating the Data Practices Act. Ms.
Hughes requested a private meeting with the Employee Review Board
and offered her expertise to the City Council with regard to Date
Practices Act.

Ms. Hughes did not submit a copy of her written statement to the
City Council at the meeting.

Mayor Buckbee noted that he felt that the City was making a good
faith effort to be compliant to the Data Practices Act.
