The legal <br />description of the property is described as Tract A, Registered <br />Land Survey Number 44, and commonly known as 1689 Peltier Lake <br />Drive. <br /> <br />The property owner would like to granted a variance to build a <br />detached garage on the R-2 Single Family Residential Zoning <br />District. <br /> <br />Motion by Wilharber to approve the variance request of 1689 <br />Peltier Lake Drive as per the recommendation of the Planning and <br />Zoning Commission, motion fails for lack of second. <br /> <br />Council member Wilharber noted that he did feel that the City <br />could not meet the justifications of standard number one. <br /> <br />Motion by Pelton, second by Wilharber that the Planning and <br />Zoning Commission consider at their next meeting an amendment to <br />Ordinance #4, Section 24 SCHEDULE OF REGULATIONS (7) which now <br />reads: <br />All future new dwellings shall have an attached double <br />garage of minimum 440 square feet <br />proposed amendment to be: <br />All future new dwellings shall have a double garage of a <br />minimum of 440 square feet <br />and that this consideration shall be addressed as soon as <br />possible, motion carried unanimously. <br /> <br />Mayor Buckbee noted with the type of scrutiny that the City <br />Council is receiving at this time, they need follow the rules <br />versus breaking the rules. <br /> <br />Theresa Davis, 7156 Brian Drive, asked what the penalty would be <br />to the City Council if they granted the variance against the <br />Ordinance #4 Standards and Justifications. <br /> <br />The Clerk/Administrator will consult with the City Attorney. <br /> <br />Florence Seashore, 1693 Peltier Lake Drive, noted that there may <br />be a drainage issue with regard to her two lots. <br /> <br />The Clerk/Administrator will contact the Building Inspector who <br />shall review the situation. <br /> <br />OLD BtJS I NESS <br /> <br />Prooosed Fire Code Ordinance <br />Motion by Pelton, second by Wilharber to approve the adoption of <br />~fdiftaft@@ *631 aft Qrd!oaft@@ id@ptiol tb@ Mlnn@~otA St~t~ Du11d1nl <br />Code and providing for it administration and enforcement <br />
