<br />(A) If, in the reasonable belief of a police officer, an animal presents an immediate danger to the <br />health and safety of any person; the animal is threatening imminent harm to any person; or the animal <br />is in the process of attacking any person, the officer may destroy the animal in a proper and humane <br />manner. <br /> <br />(B) Otherwise, the officer may apprehend the animal and deliver it to the pound for confinement. <br />If the animal is destroyed, a charge to dispose of the animal is payable by the owner of the animal. If <br />the animal is found not to be a danger to the health and safety of the city, it may be released to the <br />owner or keeper in accordance with the provisions ofthis chapter. <br />(Ord. 24, passed 10-27-1999) <br /> <br />~ 90.15 DISEASED ANIMALS. <br /> <br />(A) Keeping of diseased animal. No person shall keep or allow to be kept on his or her premises, <br />or on premises occupied by him or her, nor permit to run at large in the city any animal which is <br />diseased so as to be a danger to the health and safety of the city, even though the animal be properly <br />licensed under this section. <br /> <br />(8) Confinement. Any animal reasonably suspected of being diseased and presenting a threat to <br />the health and safety of the public may be apprehended and confined in the pound by a police officer. <br />The police officer shaH have a qualified veterinarian examine the animal. If the animal is found to be <br />diseased in a manner so as to be a danger to the health and safety of the city, the officer shall cause the <br />animal to be euthanized and shall properly dispose of the remains. Reasonable efforts will be made to <br />notify the owner or keeper of the animal prior to the euthanasia. The owner will be liable to cover the <br />cost of maintaining and disposing of the animal, plus the costs of any veterinarian examinations. <br /> <br />(C) Release. If the animal, upon examination, is not found to be diseased within the meaning of <br />this section, the animal shaH be released to the owner upon payment of the costs associated with the <br />examination. <br />(Ord. 24, passed 10-27-1999) Penalty, see ~ 90.99 <br /> <br />~ 90.16 SUMMARY DESTRUCTION. <br /> <br />Whenever an animal control officer or police officer determines that any animal presents an <br />immediate threat to the safety of any person, after making reasonable attempt to impound the animal, <br />the officer is hereby authorized to destroy the animal in the interests of public safety. <br />(Ord. 24, passed 10-27-1999) <br /> <br />~ 90.17 ENFORCING OFFICER. <br /> <br />'nRI7/17 <br /> <br />P111 <br />
