<br />be entitled to draw upon the security posted herein for replacement of any plantings. <br /> <br />(4) Developer shall not enter into any agreements with the homeowners which provide for <br />installation of the boulevard trees by the homeowners. <br /> <br />(N) Insurance. Developer(s) and/or all its/their subcontractors shall take out and maintain, until <br />the city has accepted the private improvements, public liability and property damage insurance <br />covering personal injury, including death, and claims for property damage which may arise out of the <br />developer's work or the work of his or her subcontractors, or by one directly or indirectly employed by <br />any ofthem. Limits for bodily injury and death shall be not less than $500,000 or more. The city shall <br />be named as an additional insured on the policy, and the developer or all its subcontractors shall file <br />with the city a certificate evidencing coverage prior to the city signing the plat. The certificate shall <br />provide that the city must be given 30 days' advance written notice of the cancellation of the insurance. <br />The certificate may not contain any disclaimer for failure to give the required notice. <br /> <br />(0) Costs. Cost of developer's improvements, description and completion dates shall be described <br />in the development agreement. <br /> <br />f 153.44 IMPROVEMENT AND CONSTRUCTION; MISCELLANEOUS. <br /> <br />(A) Streets. The streets shall be graded if required by the Council to the grades and dimensions <br />shown on plans and profiles and approved by the Council, and shall include the following <br />improvements: <br /> <br />(1) Suitable drainage structures, culverts, storm sewers, ditches and related installations shall <br />be provided to ensure adequate drainage of all points along the streets. There shall be no surface or at <br />grade cross-street drainage; <br /> <br />(2) Concrete curbs and gutters will be required on all streets; <br /> <br />(3) The base course shall consist of latest Minnesota Department of Highways approved <br />material, bearing a seven-ton design and shall include a geotextile fabric mat as specified by the City <br />Engineer; <br /> <br />(4) Blacktop paving as specified by the City Engineer shall be required on all streets after <br />water distribution lines, storm sewers and sanitary sewers have been installed; and <br /> <br />(5) The boulevards shall receive three inches of topsoil and be sodded. <br /> <br />(B) Sidewalks. Paved sidewalks five feet wide of portland cement, concrete or asphalt concrete <br />may be required on one or both sides of streets designated as collectors or arterials. <br /> <br />(C) Storm drainage.
