City Council Meeting Minutes
September 23, 1992
page two

Ken Vanderbeek, 6903 Centerville Road, Realty Representative for
the Acorn Creek Development, advised that he had spoken to Mr.
Moore and the property owners appear to not be interested in
selling land for park purposes at this time.

Mayor Buckbee advised that the maximum end result that he would
shoot for at this meeting would be for a sewer alignment across
Acorn Creek. He advised that he is not ready to decide other
plat issues at this time. He advised that he has concerns with
regard to intent of the Comprehensive Plan. He would like to see
the trees saved by looking closer at the ponding and notes
concern by George Haberman, 7294 Mill Road, regarding an
ordinance prohibiting front and back lot lines from both being
border by a street. He felt the City is running through these
issues quickly and that there were too many of them to make a
decision tonight. He advised he has heard concern that the lift
station on Peltier Lake Drive may not have the capacity to
facilitate the proposed Acorn Creek Development.

John Stewart, City Engineer, was available at the meeting. It
appeared to be his opinion that the discussion regarding a sewer
and water extension could be done without Preliminary Plat
approval, but it would set the alignment of 73 1/2 Street. He
noted that the Preliminary Plat and the Grading Plan have too
many variables to make a decision at this time. He noted that
there are answers, but more direction is needed before the
conclusions can be made. He noted that the lift station on
Peltier Lake Drive does have the capacity to facilitate the
proposed Acorn Creek Development with adjustments being made to
the equipment (such as installing larger impellers, making a
minor adjustment to the pumping apparatus).

Council member Burgstahler suggested that it appears to be
feasible to do the sewer extension through Acorn Creek to
facilitate the Center Hills, Third Addition and he does
understand there may be an extra cost to the developer for doing
this. He suggested that it may be more difficult to live with
predetermined strict zoning knowing areas and he prefers buffers
and progression with regard to lot sizes. He suggested that it
may be in the City's best interests to involve a planner to
review the plat. He noted that if the City and the Developer
have some flexibility both can achieve their goals. He appeared
to feel that the lots could be worked around the street areas and
would be willing to work toward the sewer extension with this in
mind. He felt that the issue that may be comprised with regard
to the extension of municipal sewer and water are street angles
and noted that there is not much room between the collector
street and the creek. It appeared to be his opinion that
amenities and house sizes were more important issues.

"'>;.t. .'.
